The petition of Henry Tifft of the city of Auburn, county of Cayuga and State of New York, . Respectfully herewith that John Tifft, late of the town of Venice in the county of Cayuga aforementioned, departed this life on or about the twentieth day of August in the year of our lord one thousand eight hundred and forty eight. That the said deceased was at the time of his death an inhabitant of the said county of Cayuga. That he has left a last will and testment which is dated the seventh day of July in the year of our lord one thousand eight hundred and forty eight. that in and by the said will the said deceased appointed your petitioner and George Tifft executor thereof. The said deceased left the following heirs at law and next of kin to wit, George Tifft, Wiatt R. Tifft, Lucy R. Gunsolus wife of Lambert V. Gunsolus of Venice Cayuga county, John Tifft of Norwalk, Huron county Ohio, Soloman C. Tifft of the city of Jackson Mississippi , Hiram Tifft of LaSalle county, Illinois and your petitioner children of the deceased. That the said deceased left Zilpah Tifft his widow who resides in Venice aforesaid. That said will related to real and personal estate. dated August 25, 1848 Signed-Henry Tifft executor. Followed by sworn affadavits of publication and notification of heirs. WILL I, John Tifft, of the town of Venice, in the county of Cayuga aged seventy two years do hereby make and declare this to be my last will and testament as follows; FIRST: I direct that all my just debts, funeral charges and expenses be paid by my executors. SECOND: I give and bequeath to my wife Zilpah the sum of three hundred dollars, to be paid to her in one year after my decease, and also three feather beds and the bedding for the same, also the household linen manufactured since our marriage, and identified by her mark or name therein. The above bequests are made subject to the conditon that my said wife shall relinquish and discharge all her interest and right which she may have or be entitled to in my now dwelling house or homestead in the said town, or the use and occupancy thereof as specified in a certain agreement mutually made and executed by us before our marriage, and bearing date Januaary 14th 1832. THIRD; I give, to my son Wiatt R. the sum of two thousand dollars, to be paid to him one year after my death, and also all the land owned by me on lot No. eight sixth part in the said town containing fifty five acres of land. Also the one sixth part of the undivided half of my household good and furniture, except the linen given to my wife. FOURTH: I give and bequeath to my daughter Lucy R. Gunsolus the sum of two thousand five hundred dollars, to be paid to her in two years after my decease, and also the one half part of all my household goods and furniture. (except the linen given to my said wife) to be divided and sent off to her by my executors winthin six months after my decease FIFTH: I give and bequeath to my faithful friend Simeon Parks the sum of One hundred dollars, to be paid in one year after my decease. SIXTH; I give and bequeath to my five sons, to wit, Henry, George, John, Solomon C. and Hiram. all and singular the rest and residue of my estate and property, both real and personal, to be equally divided between them share and share alike. But as to the real estate and lands belonging to me, I,(except that deemed to my son Wiatt R.) do hereby order and direct that my executors sell and dispose of the same at public or private sale for such price and at such time, and in such manner as may be judged best for the interest of my estates above specified to my said above mentioned five sons and my said executors are hereby enthronged to execute and deliver to the purchaser good and sufficient deed or deeds for the same. SEVENTH; I do hereby nominate, constitute and appoint my two sons Henry Tifft of Auburn and George Tifft of Venice executors of this my last will and testament Witnesses: Worthington Smith of Genoa Cayuga NY and Benjamin Arnold of Venice Cayuga N.Y.
