Town of Arkwright Chautauqua County and State of New York and Clarrissa H. his wife of Randolf of the County Catteraugus and state of New York of the first part, and ???r Eliza Sessions of the town of Arkwright of the County of Chautauqua and State of New York, of the second part, Witnesseth, That the said party of the first part, for and in consideration of the sum of Thirteen Hundred Dollars lawful money of the United States of America, to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, hath granted, bargained, sold, remised, released, aliened and confirmed, and by these presents do grant, bargain, sell, remise, release, alien and confirm unto the said party of the second part, and to her heirs and assigns for ever, All that certain piece or parcel of Land Situate in the town of Arkwright in the County of Chautauqua and State of New York, being part of Lot Number Nineteen in the Fifth Township Eleventh Range and Bounded as follows. On the North by part of lot Number Twenty sixteen chains Eighty three links. On the East by part of lot Number Eleven thirty nine chains fort six links and to lands Deeded to Daniel Mathewson. On the south by lands Deeded to Daniel Mathewson Sixteen chains Eight three links and to lands Deeded to David Durfee and On the West by lands Deeded to said David Durfee thirty nine chains forty three links and to the North bounds of said lot Number Nineteen. Containing Sixty eight acres be the same more or less. $2.00 Stamp cancelled. Together with all and singular, the hereditaments and appurtenances thereunto belonging, or in any wise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title interest, dower claim or demand whatsoever, of the said party of the first part, either in Law or Equity, of, in, and to the above bargained premises, with the said hereditaments and appurtenances, To Have and to Hold the said premises, as above described, with the appurtenances, unto the said party of the second part, and to her heirs and assigns forever, and the said Bethuel H. Town and Clarrissa H his wife for themselves their heirs, executors and administrators, do covenant, grant, bargain and agree to and with the said party of the second part, her heirs and assigns, that at the time of the ensealing and delivery of these presents, they were well seized of the premises above conveyed, as of a good, sure perfect, absolute and indefeasible estate of inheritance in the Law in Fee Simple: And that the above bargained Premises, in the quiet and peaceable possession of the said party of the second part, her heirs and assigns, against all and every person or persons, lawfully claiming or to claim the whole or any part thereof, they will for ever Warrant and Defend. On this Eleventh day of May 1863 before me the subscriber personally appeared Bethuel H Town who acknowledged that he executed the written instrument and I certify that I know the person who made the said acknowledgment to be the individual described in and who executed the within instrument. M. H. Town. Justice of the Peace State of New York, Cattaraugus County. ss. On this [31?] day of April 1863, before me the subscriber personally appeared Clarissa H. Town wife of Bethuel H. Town and acknowledged that she executed the within instrument. An the said Clarisa H Town on a private examination apart from her husband acknowledged that she executed the within instrument freely and without any fear or compulsion of her husband. And I further certify that I know the person who made the said acknowledgment to be the individual described in and who executed the within instrument. Edwin McManus Justice of the Peace. Lyman clerk of the said county and of the courts thereof do hereby certify that Edwin McManus Esq before whom the ???? ?? proof or acknowledgment purports to have been taken was at the date of the same a Justice of the Peace in and for said county and duly authorized to take the same and that I am well acquainted with his hand writing and verily believe his signature to said certificate is genuine.
