Town of the Town of Arkwright, County of Chautauqua and State of New York of the second part, Witnesseth, That the said part of the first part, for and in consideration of the sum of Two Thousand eight hundred and Three 90/100 dollars lawful money of the United States of America, to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, have granted, bargained, sold, remised, released, aliened conveyed and confirmed, and by these presents do grant, bargain, sell, remise, release, alien convey and confirm unto the said party of the second part, and to his heirs and assigns for ever, all that certain piece or parcel of Land Situate in the Town of Arkwright aforesaid and is distinguished by the North East part of Lot number sixty-two (62) in the fifth Township and eleventh range of the Holland Land Company's Survey, Bounded West by land formerly deeded to Abram Orton thirty (30) chains and Twenty Nine (29) links, North by lot number sixty three (63) twenty (20) chains and three (3) links East by lot number fifty-four (54) thirty (30) chains and twenty-nine (29) links and South by a line parallel to the north bounds of said Lot number sixty-two, Nineteen (19) chains and fifty nine (59) links, containing sixty acres. Together with all the lands lying on the North and West sides of the land hereby described up to the fence enclosing the said Land on said North and West sides. Also all the surplus land lying on the South side of the above described land. Also another piece of land in said Township being, part of lot number fifty four (54). Beginning at the northwest corner thereof running thence East along the North bounds thereof Nine (9) chains and Eighty One (81) links to a post. Thence South parallel to the West bounds of said Lot, Twenty One (21) chains and Ninety (90) links to the center of the road. Thence North Sixty One (61) degrees West along the center of said road to the West bounds of said Lot. Thence North along the West bounds of said Lot seventeen (17) chains forty (40) links to the place of Beginning, containing Nineteen 3/4 acres, More or less. The premises hereby conveyed being the same now and heretofore Occupied by the party of the first part and formerly Owned and Occupied by Moses Tucker now deceased. $5 Stamp Cancelled Together with all and singular, the Tenements hereditaments and appurtenances thereunto belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title interest, claim or demand whatsoever, of the said party of the first part, either in Law or Equity, of, in, and to the above bargained premises, with the said hereditaments and appurtenances, To Have and to Hold the said premises, as above described, with the appurtenances, unto the said party of the second part, and to his heirs and assigns, for ever; and the said Chauncey Tucker for himself his heirs, executors and administrators, do covenant, grant, bargain and agree to and with the said party of the second part, his heirs and assigns, that the above Bargained Premises, in the quiet and peaceable possession of the said party of the second part, his heirs and assigns, against all and every person or persons, Except the Mortgagees hereinafter mentioned or their assigns lawfully claiming or to claim the whole or any part thereof, the will for ever Warrant and Defend. This deed is made subject to a mortgage Executed by Chauncey Tucker to the Commissioners for loaning certain moneys of the united states of the county of Chautauqua upon which Mortgage there is now due five hundred and thirty dollars and interest from October 1st, 1863 which Mortgage said Town agrees to pay DIS. - see Mtg. No. 294 In Witness Whereof, The said party of the first part have hereunto set their hands and seals the day and year first above written. On this 26 day of April 1864, before me, the subscriber, personally appeared Chauncey Tucker and Florella R his wife, and acknowledged that they had severally executed the within instrument. And the said Florella R on a private examination, apart from her husband, acknowledged that she executed the within instrument freely, and without any fear or compulsion of her husband. And I further certify, that I know the person who made the said acknowledgement to be the individual described in, and who executed the within instruments.
