The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Chautauqua Co., NY Will Book Vol. 10 page 348 I Rolfe Eggleston of the town of Sherman, County of Chautauqua and State of New York, do hereby make and publish my last will and testament intending thereby to dispose of all my worldly estate of which I shall be possessed at the time of my decease. First After the payment of all my just debts and funeral expenses I give and bequeath to my beloved wife Hannah K. Eggleston in leiu of dower, the sum of two thousand dollars. Second I give and bequeath to my daughter Sarah E. Scott the sum of five hundred dollard, subject to the provisions of section No. 7 of this my last Will and Testament. Third I give and bequeath to my daughter Hoduska A. Hubbard, five hundred dollars subject to the provisions of section No. 7 of this my last Will and Testament. Fourth I give and bequeath to my son Frank Eggleston the sum on one thousand dollars, subject to the provisions of section No 7 of this my last Will and Testament. Fifth I give and bequeath to my son Theodore J. Eggleston the sum of one thousand dollars, subject to the provisions of section No 7 of this my last Will and Testament. Sixth I give and bequeath to my to my son Willie R. Eggleston the sum of one thousand dollars, subject to the provisions of section No 7 of this my last Will and Testament. Seventh I declare that all such moneys as I have or shall have advanced to any of my said children or as shall be owing to me from any of them at my decease, shall be considered as part of my resiuary estate and shall be deducted from his, her or their respective portions as herein before provided. Eighth I devise and bequeath all the rest, residue and remainder of my real and personal property of what nature of kind woever to my said wife Hannah K. Eggleston Ninth I hereby direct that my executrix hereinafter appointed shall execute to my son Theodore J. Eggleston a good and sufficient warranty deed on one hundred and thirty eight acres of land, according to the description hereto annexted (being a part of my farm now owned by me for the consideration of four thousand dollars, provided he executes to her a bond and mortgage on the said premises to secure to her the aprment of the said sum of $4000 or so much thereof (Principle and interest) as may at the time of my decease remain unpaid, upon such terms as to her shall seem meet. Tenth I hereby direct that my executrix hereinafter appointed, shall execute to my son Willie R. Eggleston a good and sufficient warranty deed of one hundred acres of land according to the description hereto annexed (being a part of the farm now owned by me) for the consideration of two thousand dollars provided he executes to her the payment of the said sum of $2000 or so much thereof (principal and interest) as may at the time of my decease remain unpaid upon such terms as to her shall seem meet. Eleventh I give and devise all my real and personal estate of what nature or kind soever to my said wife Hannah K. Eggleston, my executrix hereinafter appointed in trust, for the execution of my will, with power to sell and dispose of the same; at private or public sale, at such times and upon such terms and in such manner, as to her shall seem meet, provided however that the real estate mentioned in sections 9 and 10 shall be disposed of as therein directed. Lastly I hereby nominate and appoint my said wife Hannah K. Eggleston to be the executrix of this my last Will and Testament, hereby revoking all former wills by me made. In Witness whereof, I Rolph Eggleston have to this my last Will and Testament consisting of one sheet of paper with the annexed descriptions of land, subscribed by name and set my seal this 7th day of September A.D. 1877.
