S. Moss, of the Town of Portland, County of Chautauqua, and State of New York, of the age of sixty-six years and being of sound mind and memory do make, publish and declare this my last Will and Testament in manner following that is to say: I give and bequeath to my wife, Helen C. Moss the use of the homestead where I now live during the term of her natural life, said homestead containing about twenty five acres, with all the appurtenances thereto belonging, excepting therefrom the house and lot where I do now live. I give and bequeath to my said wife all the household goods in said homestead and all the persons property therein consisting of horses, wagon, stock, tools used in carrying on said place. After the decease of my said wife, I give and bequeath and devise the said homestead as above given to my wife to use, to my daughter, Helen Dunham, for her use and benefit during the term of her natural life, and at her decease, I will that said homestead shall be equally divided between her children surviving her and if she shall leave no children, she shall dispose of said homestead as she see fit. I give and devise to my daughter, Emma V. Roberts, that portion of the Morrison farm now occupied by them consisting of about forty-five acres being all of said farm lying north of the Main road unsold excepting fifteen acres I now occupy and the right of way to it during her natural life and at the decease of my said daughter, I will that said farm shall be divided between her children then surviving her, share and share alike. I give and bequeath to my daughter, Lucy C. Merick a note for Thirty-eight hundred dollars I hold against J. A. Merick and a sum sufficient with the interest thereon to make in all to said Lucy the sum of Six thousand dollars. I give and devise to my son, T. C. Moss, my brick store in Brocton and a piece of land bought of Ladue the same width as the brick store lot through to Jones lot, also my gold watch and chain and Five hundred dollars in money. I give and devise to my son, Edward S. Moss the farm I purchased of Geo. Wright containing about sixty-seven acres with the appurtenances thereto belonging together with all the personal property thereon and I give to said Edward all the notes and accounts I have against him, said farm and personal property to be used by him during his natural life and at his decease I will that the same shall be divided equally between his children share and share alike. I give and bequeath to my daughter, Ida May Phillips, the house and lot where she now lives. I also give to my said daughter, Ida, a note I hold against B. D. Phillips for about $2,000. and twenty-five hundred dollars in money. I give and bequeath and devise to my wife, Helen C. Moss, all the rest, residue and remainder of my estate both real and person for her use and benefit during her natural life and at her decease, I will that the same shall be divided equally between my children, share and share alike. I hereby appoint my son, T. C. Moss, and my son-in-law B. D. Phillips, Executor of this my last Will and Testament hereby revoking all forms and wills by me made. Witness my hand and seal October 2nd, 1889. The above instrument consisting of one sheet was at the date thereof signed, sealed, published and declared by the said T. S. Moss as and for his last Will and Testament who requested us to sign the same as witnesses thereto, and that we did sign the same as witnesses in his presence and in the presence of each other. s/W.
