I Nathan Eggleston of the town of Harmony and in the county of Chautauqua being mindful of my mortaility do this twenty fifth day of January in the year of our Lord one thoughsnad eight hundred and forty eight make and publish this my last will and testament in manner following. First I desire that myself and wife be decently buried in the burying yard in Panama without any funeral (poump) and with as little expense as may be. Second I will to my son Nathan Eggleston Junr. Eighty acres of land lying and being in the town of Harmony and distinquished by being a part of lot forty six and a part of lot fifty four boundary not described by taken from a deed owned by the said nathan Eggleston and taken off of the north side of land so deeded etc. I will to the said Nathan Eggleston Junr. All the horses, cattles, sheep and farming utensits excepting three cows will to other heirs to be delivered in one year after the decease of the said nathan Eggleston and wife. Third I will and bequeath to my Granddaughter Eliza Pier one cow to have in one year after the decease of myself and wife. Fourth I will and bequeath to my granddaughter Polly Eddy one cow to have in one year after the decease of myself and wife. Fiftly I will and bequeath to my granddaughter Amanda Hitchcock, one cow to have in one year after the decease of my self and wife. Sixthly I will and bequeath to my daughter Patience Covey the remaining part of my said land lying and being in the town of Harmony and distinquished by being a part of lot forty six and fifty four as aforesaid and further I will to my daughter Patience Covey my bed and bedding after the decease of myself and wife. Seventhly the said Nathan Eggleston Junr. To maintain the said Nathan Eggleston and his wife Mary and pay all debts unpaid or due and also to pay all charges that may arise or acru in consequence of sickness of any other means during the natural lives of the said Nathan Eggleston and his wife Mary. And I do hereby constitute and appoint my son Nathan Eggleston Junr and Nathan Chamberlain executors of this my last will and testament in witness whereof I have hereunto set my hand and seal the day and year first above written. The above instrument constituting one sheet was was hereby subscribed Nathan Eggleston the testator in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witness. Nathan Chamberlain, residing in the town of Harmony in the county of Chautuaqua Myron Eggleston, residing in the town of Harmony in the county of Chautuaqua David Wiltse residing in the town of Harmony in the county of Chautuaqua Chautuaqua County Surrogates Office Recorded the proceding last will and testament of Nathan Eggleston and passed the same with the original this 9th day of January 1855. E. F. Warren, surrogate At a Surogate's Court helf at Mayville in and for the County of Chautauqua on the 9th day of January 1855 before Emery F. Warren, Esquire, Surogate of said County. In the matter of the Estate of Nathan Eggleston Deceased. . . the said deceased died on the 2nd day of February 1854. At the time of his death he was an inhabitant of the town of Harmony in the County of Chautauqua. . . The followin named persons are all the heirs and next of kin of the said deceased, with their ages and places of residence as nearly as can be acertained viz: Nathan Eggleston the petitioner, Patience Covey, wife of John Covey, Eliza Pier, wife of Calvin Pier residets of the said town of Harmony, Amanda Whiting, wife of Fred Whiting a resident of Busti in said county, & Polly Eddy wife of John Eddy resident of the County of Warren, State of Pennsylvania all of full age that the said deceased left no widow ( ) surviving. . . Will filed with deeds with this added: Nathan Eggleston being duly sworn deposed and saith that the reasons of his making provision for his wife Mary in the manner it is made and making (provision) of the property after his death is in consequence of her being in a deranged state of mind and has been for (parts) of thirty six years before ( ) date. 7th day of January 1848.
