Cardott. I John B. Cardott of the town of Charlotte County of Chautauqua and State of New York being of sound mind and memory do make publish and declare this last will and testament as follows that is to say; I give and devise to my wife Clarissa Mary Cardott all that part of my real estate situate on lot number fifty six in said town lying on the south side of the highway which runs easterly and westerly through said lot and also ten acres of land adjoining said highway on the north side thereof and bounding on the said highway the whole breadth of my farm situate on said lot number fifty six to have and to hold the same so long as she shall remain my widow and in case of the death or second marriage of my said wife then I give and devise the real estate aforesaid to my daughter Julia Bouquin and my sons George Cardott and Charles Cardott in fee simple to be equally divided between them all. The rest residue and remainder of my real estate I give to my daughter and sons aforesaid to them their heirs and assigns forever. I give and bequeath to my son John B. Cardott the sum of two hundred and twenty five dollars also to my son Joseph Cardott the like sum of two hundred and twenty five dollars also to my son Jacob Cardott the like sum of two hundred and twenty five dollars. To my sons August Cardott and Francis Cardott. To my daughter Rose Belandick wife of Francis Belandick and to my step sons who are the sons of my said wife Servis Simmons and John Simmons, each the like sum of two hundred and twenty five dollars to be paid to each out of them in the order their names are mentioned in this will That is so first mentioned John B Cardott shall be paid the amount herein bequeathed to him at the end of two years after my son Charles shall arrive at the age of twenty one years or in case I shall be living then at the end of two years from and after my decease and the like sum of two hundred and twenty five dollars shall be paid to the legatee entitled to the same according to the order and manner of payment aforesaid in each and every year thereafter until the whole be paid and discharged. And all the above named legacies to my said children and step children shall constitute a charge upon my real estate hereunto devised to my daughter Julia and my sons Walter George and Charles until the same be paid. The residue of my real estate heretofore mentioned in this will shall not include a lot of fifty acres of land situate on lot number thirty four in the town of Arkwright but the use and ___________ of said lot is hereby devised to my daughter Mary _________ Christy during the term of her natural life and after her decease I give and devise the same to her children or such of them as shall then be living to be equally divided between them. I give and bequeath after the payment of my debts and funeral charges all my personal estate to my daughter Julia Bouquin to my sons George Cardott, Walter Cardott and Charles Cardott to be equally divided between them and I hereby charge my four last named _________ the support of my said wife so long as she shall continue my widow And I hereby revoke all former wills by me made at any time heretofore. “And Francis” Cardott was mentioned on the second page between the fifth and sixth lines before execution. Given under my hand and seal this 24th day of August 1852. Signed: J.B. Cardot (S.S.) The above instrument was subscribed by John B. Cardot the testator at the date thereof in our presence who at the same time declared the same to be his last will and testament and we at his request and in his presence and in the presence of each other subscribe our names hereto as attesting witnesses. Signed: John C. Griswold of the Town of Arkwright Chautauqua County Morgan S. Rice of the Town of Charlotte Chautauqua County Codicil to the last will and testament of John B. Cardot – I John B. Cardot of the town of Charlotte County of Chautauqua and State of New York do make publish and declare this to be a codicil to the foregoing will that is to say, I hereby revoke all that part of said will wherein I bequeathed two hundred and twenty five dollars to my son Francis Cardot whose name was interlined between the fifth and sixth lines on the second page of the foregoing instrument. In testimony whereof I have hereunto set my hand and affixed my seal this 15th day of October 1852. Signed: J.B. Cardot (S.S.) The execution of the foregoing instrument was duly acknowledged by John B. Cardot to each of us and declared by him in the presence of each of us to be a codicil to his last will and testament and we at his request and in his presence subscribe our names hereto as attesting witnesses.
