I Hiram SHELTERS of the Town of Poland in the County of Chautauqua and State of New York of the age of Sixty-three years and being of sound mind and memory do make publish and declare this my last Will and Testament in manner following that is to say: First-I give and devise all of my Real deed Personal Estate (Except herein after mentioned), of what nature or kind (unreadable) to my wife Margaret to be used and enjoyed by her during the term of her natural life. And after her decease. Second-I give and devise to my daughter Alice SHELTERS one fourth of an acre of land situate in the village of Kennedy being the same which I bought of Wm SMITH and wife, by deed bearing date the 26th day of March 1867, her heirs and assigns forever. Third I give and devise to my son Theodore SHELTERS, fourteen acres of land in lots 24 and 32 being the same which I bought of F. HENRY by deed bearing date September 15th 1868, his heirs and assigns forever. Fourth, I give and devise to my son Ervin SHELTERS thirty acres of land from lots 24 and 32, bought of F. HENRY bounded as follows Beginning at the North East corner of 30 acres which I bought of W.S. GAYLORD, and running thence eastwardly to the corner of J. SWANSONS land in the center of the highway, thence North to E. C. WILLIAMS' land and Thence west along his line until you strike his South-West corner, Thence North to C. Carters land and thence West along said Carters South line far enough (with the (unreadable) remaining lines) to contain ten acres. Thence South far enough and thence East until you strike the said E.C. WILLIAMS South-west corner. Thence South far enough to a stake and thence East until you strike my old survey line, and thence South on said line to the place of beginning. The last description of lines to embrace 20 acres, according to a map or survey accompanying this Will. The said Ervin SHELTERS shall after the expiration of four years from the death of my said wife Margaret pay to my sons Walter SHELTERS and Edward SHELTERS the sum of five hundred dollars each their heirs and assigns in consideration of said 30 acres is (this section continued below). Fifth- I will and devise to my son Thaddius SHELTERS the remainder of my land and real Estate supposed to contain Seventy acres. On his paying six hundred dollars to the heirs of my daughter Ann Elizabeth, and Six hundred dollars to the heirs of my Son Charles SHELTERS, on the expiration of four years, from the death of my said wife Margaret SHELTERS. Sixth- I give and bequeath to my son Erin? SHELTERS my carpenter's tools of (unreadable) nature or kind (unreadable). (This is the (unreadable) of the fourth Section). I give and devise to my Son Ervin SHELTERS the balance of my land lying on the East side of the highway leading to Ellington, supposed (unreadable) to contain 13 or 14 acres the same I bought of F. HENRY by deed bearing the 14th day of November 1866 his heirs and assigns forever. And hereby direct my Executor to collect G.A. ALDRICH's note of $600.00 due May 1st, 1872 and my account of about $600.00 for wood delivered the A. (unreadable) G. W. Rail Road Co. and out of the proceeds. Pay Acenath BAKER $300 for which she holds my note, Also Pay F. HENRY, his next payment on land, hereafter to be come due and also that she cut and dispose of enough Wood and Timber from my timbered lands to finish paying the said HENRY for the same or any other lawful debts against my said Estate. Lastly I hereby appoint my said wife Margaret Sole Executrix of this my Last Will and Testament, hereby revoking all former Wills by me made. The above instrument consisting of one shut was a the date thereof signed sealed published and declared by the said Hiram SHELTERS as and for his last Will and Testament in presence of as who at his request and in presence and in the presence of each other have subscribed our names as witnesses thereto.
