All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ny/nyfiles.htm *********************************************************************** Source: SAMPUBCO photocopy Chautauqua co NY Will Book Vol. 7 page 562 Written: 29 Mar 1877 Probated: 20 Mar 1883 In the name o God Amen: I Isaac Cobb of the Town of Ellicott in the County of Chautauqua and State of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this my last Will & Testament, that is to say: First, After all my lawful debts are paid and discharged, I give and bequeath unto my wife Lydia, if she survives me the full interest and free use of all my estate during the remainder of her natural life, subject and according to a certain agreement or contract made and entered into by me, with my son Isaiah on the first day of April 1871, to be accepted and received by her in lieu of Dower. Second, I give and bequeath to my daughter Lorna, Four Hundred Dollars ($400) also all my household goods of any kind. I also recognize as a just and lawful debt, a certain note, which she now holds against me for the sum of Five Hundred Dollars ($500) to be paid in one year after my decease and that of my said wife without interest. Third, I give and bequeath to my son Isaiah the sum of Eight Hundred Dollars ($800). Lastly, I will and direct that all the rest, residue, remainder of my estate after paying, fulfilling, and satisfying all of the above provisions and bequests and setting aside and after appropriating a sufficient sum to defray all funeral expenses and exacting a suitable environment at the place of internment of myself and said wife, be divided into five equal shares, and one of said shares I give to my daughter Jane, now wife of Zeanas D. Clark, one share each to my son Isaiah and daughter Lorna, and one of said shares I give to my two Grand Daughters now Mrs. Charlotte Luther and Mrs. Olive Kine to be apportioned equally between them, and the one remaining share I give and bequeath to my Grandson John Sealy and his sister Mrs. Lorinda Marion to be apportioned equally between them share and share alike. But the share of my daughter Mrs. Jane Clark shall be fully paid and satisfied & cancelled on the presentation of a receipt by the Executor of this will given me for One Hundred and eighty five Dollars ($185) money heretofore advanced her husband and bearing his signature, and in case of my daughter Lorna shall present an account for services of labor since the date of the said ($500) note heretofore mentioned, then the bequest of Four Hundred Dollars ($400) herein before to her made is hereby revoked ad I direct that the same be included in the sum to be divided into five equal shares as before mentioned. I also direct that all the bequests hereinbefore made by paid in one year after the death of both myself and my said wife Lydia, excepting that bequeathed to her, which will take effect immediately upon my death, all of said bequest to be paid without interest (up to the time above specified for payment). I make constitute and appoint Geo W. Rugg to be sole Executor of this my last Will & Testament hereby revoking all former Wills by me made. The above written instrument consisting of one sheet was subscribed by he said Isaac Cobb at the date thereof, in our presence and at the same time he declared the said instrument to be his last Will & Testament, and requested us to sign our names as witnesses, which we do in his presence and in the presence of each other.
