I John M. Grant considering the uncertainty of life and being of sound mind and memory do make ordain publish and declare this to be my last, Will and Testament, in the manner following, that is to say: After all my lawful debts are paid and discharged First. I give and bequeath unto my beloved wife Sarah M. Grant all my household and housekeeping furniture, including beds and bedding, carpets, plate, silver ware, cutlery, books, paintings pictures, stationary, and ma ts: and to her my said wife Sarah M. Grant, I do also give and bequeath, all my clothes, clothing, and wearing apparel Second. I do also give and bequeath unto my said wife Sarah M. Grant the sum of Five thousand dollars. (5000.) dollars Third. All the rest and residue of my property both real and personal I give devise and bequeath unto her, my said wife Sarah M. Grant and unto my son James Mullett Grant, share and share alike, but this third devise and bequest, and said second bequest to wit: of Five Thousand dollars, are so made, and each thereof is made, upon the express and following condition, that is to say: the said second bequest of said Five thousand dollars and said third devise and bequest of said rest and residue are so made and each thereof is so as afore said made, upon the express condition that she my said wife Sarah M. Grant shall within one year from the day of my death, release, quit claim and remise unto my legal representatives, all her right title and interest in and to the premises situate on the north west corner of Second and Lafayette streets in Jamestown aforesaid, and described in a lease by me to my said son for the life of her my said wife, to the end that its said premises be administered upon as a part of my estate. Otherwise than said condition and if my said wife shall not perform the same, then as to all of the said Five thousand dollars mentioned in said second bequest, and as to all of said rest and residue of my property both real and personal in said third devise and bequest described, lie intestate; to the end that the same, said Five thousand dollars and said rest and residue, may be distributed under and according to the statutes of the State of New York. Fourth. If my said wife Sarah M. Grant is dead at the time of my decease, then, and in that case, I give devise and bequeath all the property both real and personal whereof I die seized or possessed unto my said son James Mullett Grant. Fifth. If my said son James M. Grant at the time of my decease is dead, then and in that case, I give devise and bequeath all the property both real and personal whereof I died seized or possessed unto her my said wife Sarah M Grant I hereby make constitute and appoint my said wife Sarah M Grant to be Executrix, and Charles P. Adams of Randolph New York and Robert N. Marvin of Jamestown New York to be Executors of this my last Will and Testament, I hereby revoke all former Wills and Testaments and codicils thereto by me made. In Witness Whereof I have hereunto subscribed my name and affixed by seal the Twenty second day of September in the year of our Lord one thousand eight hundred and seventy nine. John M. Grant L.S. Grant, in our presence and acknowledged by him to each of us; and he, at the same time declared the above instrument so subscribed to be his last Will and Testament, and we at his request, have signed our names as witnesses thereto, in his presence and in the presence of each other and written opposite our names our respective places of residence on September 27th 1879.
