Probate documents and Last Will and Testament of CHARLES T. HILL, Millport, Town of Veteran, County of Chemung, New York. At a Surrogate's Court, held in and for the County of Chemung, in the State of New York, at the office of the Surrogate in the city of Elmira, on the 20th day of November, 1899, In the Matter of Proving the Last Will and Testament of Charles T. Hill, deceased. Be it Remembered, That heretofore, to wit: On the 9th day of November in the year of our Lord, one thousand eight hundred and ninety-nine, before the Surrogate of the County of Chemung, came CARRIE L. HILL named as Executrix in the Last Will and Testament of CHARLES T. HILL, late of the Town of Veteran in said County of Chemung, deceased, and by petition in due form, made application to have the Last Will and Testament of CHARLES T. HILL, which relates to both real and personal property admitted to Probate, and on such application, being made, the said Surrogate duly ascertained who were the widow heirs at law and next of kin of the said Testa___ and entitled to notice of the time and place of proving said Last Will and Testament and found their names, relationship and respective places of residence to be as follows to wit: Mary L. Hill, daughter, Town of Veteran, NY Mabel A. Hill, daughter, Town of Veteran, NY Carrie L. Hill, widow, Town of Veteran, NY And thereupon said Surrogate issued a Citation in due form of law, directed to said _________ heirs at law and next of kin, requiring them and each of them to be and appear in said Surrogate's Court, in the Court House, in the City of Elmira, in the County of Chemung, on the 20th day of November, 1899, to attend the probate of said Last Will and Testament. That afterwards and on or before the return day of said Citation, due proof was made and produced to said Surrogate of the due service of said Citation, in the manner prescribed by law; and Seymour Lowman, Esq., having been duly appointed the special guardian of the infant parties to this proceeding; That on the 20th day of November A.D.,1899, no one appearing to oppose the probate of said Last Will and Testament ________________ said Surrogate proceeded in open court to take the proofs, of the due execution of said Will and after taking such proofs, did thereupon adjudge the said Will to be the Last Will and Testament of CHARLES T. HILL , deceased, and as such a Will valid, to pass real and personal property, which said Last Will and Testament ________________ and proofs are as follows, to wit: THE WILL I, CHARLES T. HILL of Millport County of Chemung & State of New York being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament, that is to say: First.- After all my lawful debts are paid and discharged, I give, devise and bequeath to my wife, CARRIE L. HILL my personal property of every name and nature, also the Real Estate known as the P.O. situated in the Village of Millport. Second.- Giving her the use and controll of my farm where I now live during her natural life after which it shall go to my daughters Mary and Mabel. Third.- I hereby nominate and appoint my Wife the executrix of this my last will & testament & hereby authorize and empower her the said wife CARRIE L. HILL to compound compromise & settle any claim or demand which may be against or in favor of my said estate. In witness whereof I hereunto set my hand and seal this 15th day of June 1886. C.T. Hill L.S. signed, published & declared by the said testator to be his last will and testament in the presence of us who have signed our names at his request as witnesses in his presence and in presence of each other. H.E. SMITH residing at Watkins, NY (L.S.) HATTIE GOBLE, residing at Veteran, NY (L.S.) THE PROOFS In the Matter of Proving the Last Will and Testament of CHARLES T. HILL, deceased. Chemung County, SS. HATTIE BAUER of Penn Yann, Yates County, but now living in Chemung County, and HERMAN E. SMITH, being severally and duly sworn in open Court, doth each for himself, doth depose and say that they are subscribing witnesses to the Last Will and Testament of CHARLES T. HILL, late of the Town of Veteran in the County of Chemung and State of New York, deceased. And these deponents do further say that the said CHARLES T. HILL, deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing which is now here shown to these deponents and which purports to be the Last Will and Testament of said deceased, and which bears date on the 15th day of June, one thousand eight hundred and eighty six. That the said deceased did at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his Last Will and Testament; and these deponents did thereon subscribe their own respective names at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence and in the presence of each other.
