All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ny/nyfiles.htm Submitted Date: May 24, 2006 This file has been created by a form at http://www.genrecords.org/nyfiles/ File size: 4.8 Kb ************************************************ Written: March 11, 1822 Recorded: March 12, 1822 Book CC, p 434 Josiah and Fanny White to Daniel Shumway and Peleg Glover This indenture made the eleventh day of March in the year our Lord one thousand eight hundred and twenty two Between Josiah White of the town of Preston and Fanny his wife of the first part and Daniel Shumway and Peleg Glover of the second part Witnesseth that the said parties of the first part for and in consideration of the sum ofthree hundred dollars money of account of the United States to them in hand paid by the said party of the second part the receipt whereof is hereby confessed and acknowledged have granted bargained sold remised released aliened and confirmed and by these presents do grant bargain sell remise release alien and confirm unto the said parties of the second part and to their heirs and assigns forever All that certain piece parcel or tract of land being part of lots number five and six in Butlers Range in township Number fourteen one of the twenty towns laid out for sale on the west side of the Unadilla River in the town of Preston county of Chenango and state of New York being those parts of lots number five and six aforesaid not conveyed to John Avery by eed having date the third day of October one thousand eight hundred and fifteen and all on the part of said lots bounded North by tract number seven East by land now or late of Guy Richards south by part of lot number four and west by by the east line of the said John Avery 's land containing sixty acres be the same more of less subject to the exceptions and reservations contained in the original letters pattent from the State. Together with all and singular the hereditaments and appurtenances therunto belonging or in any wise appurtaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate right title interest claim and demand whatsoever of the said party of the first part title in law or equity of in and to the above bargained premises with the said hereditaments and appurtenances To have and to hold the said premises above particularly mentioned and described and every part and parcel thereof with the appurtenances to the said parties of the second part their heirs and assigns to the sole and only proper use benefit and behoof of the said parties of the second part their heirs and assigns forever. And the said party of the first part do for himself his heirs executors and administrators command and agree to and with the parties of the second part their heirs and assigns that he is the true and lawful owner of the said tract or parcel of land and premises with their appurtenances and is lawfully seized in his own right of a perfect absolute and indefensible estate of inheritance in fee simple of and all the said premises with their appurtenances and has in himself good right full power and lawful authority to grant and convey the same in manner aforesaid. And also that the said parties of the first part for himself his heirs Executors and administrators do command grant bargain promise and argue to and with the said party of the second part their heirs and assigns to forever Warrant and defend the above bargained premises and every part and parcel thereof now being in the quiet and peaceable possession of the said party of the second part against the said party the the first part his heirs executors administrators and assigns and against all and every other person or persons claiming or to claim the said premises or any part thereof In witness whereof the said party of the first part have hereunto set their hands and seals the day and year first above written Josiah White Fanny White State of New York ss Be it remembered that on the 11th day of March 1822 before me came Josiah White and Fanny his wife whom I know to be the persons named in and who executed the written deed and severally acknowledged that they executed the same for purpose therein mentioned and contained The said Fanny being examined by me separate and apart from her husband acknowledged that the executed the same without fear or compulsion from him.
