To all to whom these presents shall come or may concern send greeting. Know ye that at the Town of Oxford in the County of Chenango on the sixth day of December, one thousand eight hundred and fifteen, before John Tracy Esquire, Surrogate of our said county the last will and testament of Peter German, deceased. (A copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this State by means whereof the proving and registering the said Will and the granting administration of all and singular, the said good, chattels and credits and also the auditing allowing and final discharging, the amount thereof doth belong unto us, the administration of all and singular the goods, chattels and credits of the said deceased and any way concerning his will, is granted unto Obadiah German, James German and Joshua Lamb executors in the said will named, they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular, the said goods, chattels and credits and also to render a just and true amount thereof when there unto required. In testimony whereof, we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness John Tracy Esq., Surrogate of the said county at the town of Oxford aforesaid, the thirteenth day of December in the year of our Lord, one thousand eight hundred and fifteen and of our independence, the fortieth. John Tracy, Surrogate I, Peter German of Columbus in Chenango County and State of New York, being weak and infirm in body, but in mind sound and in possession of all my rational faculties, do make this my last will and testament in manner following to wit. That after my decease, my body be decently buried and the expense of the funeral together with all my just debts be paid. And I do hereby give and bequeath to my beloved wife Hannah, in addition to her right of dower or thirds of my real estate during her natural life, two beds and bed clothes for them. Together with so much of my household furniture as may be necessary for her to continue housekeeping. And I do hereby give and bequeath all of the remainder of my estate, real as well as personal unto my beloved children, their heirs and assigns forever in the following manner and proportions. Namely each of my sons to have and receive at and after, the rate of two dollars value. To each of my daughters, having and receiving the value of one dollar. And whereas I have advanced to several of my children, money or property to a considerable amount, I do order and direct that the sum of Eighty dollars be and remain a charge against my son David. And that one hundred and fifty dollars, be and remain a charge against my son William. And that fifty dollars be and remain a charge against my son Silas. And that one hundred dollars be and remain a charge against my daughter Sarah Lamb. And all of these several sums shall be added to the amount of my estate and then deducted from their several shares according to the charge against each. And I do hereby authorize and give full power unto the executors to this, my last will and testament who are herein after named, to sell all my real as well as personal estate taking care to make no waste or sacrifice in so doing. And when sold, to pay over to all of the heirs that are of full age, their respective shares or portions of said estate. And the money or shares belonging to those of my heirs, who may be under age, shall be placed at interest on good land securities by my executors and the interest applied to their support and education until they are of lawful age. Then the principal shall be paid to them or their lawful heirs. And in case my executors should deem it prudent and proper to spend a part of the principal of the shares of my estate belonging to my two youngest children in giving them an education, they may do it provided they expend no more than one half of the principal. And in case my beloved wife Hannah shall consent to sell her Dower or thirds of my real estate, it may be sold by my executors with the rest of my real estate. And the monies received therefore shall be placed at interest by my executors on their taking care to take good land security as aforesaid. And the use or interest thereof shall be paid to my beloved wife during her natural life, for her support and at her sole disposal. And at or after her decease, the money arising from the sale of her thirds or third part of my real estate shall be divided amongst all my children or their heirs agreeably to the principles of this will. And I do hereby constitute and appoint as executor of this, my last will and testament, my brothers Obadiah and James German, and my son in law Joshua Lamb. Giving them or any two of them or the survivors or survivor of them, full power and authority to do and perform all things required of them. By this my last will and testament, their exercising their discretion as to the time and manner of selling my real estate. Given under my hand and seal this thirteenth day of September in the year of our Lord, on thousand and eight hundred and fifteen. Peter German The words right of dower in the eleventh line, first page and the words during her natural life in the twelfth line, and the words on good land security at the end of the twenty fourth line, second page, and the words dower in the eleventh line, third page, was initialized before this will was executed. Witness Present Andw Burchard Nicholas Richer Israel Brownell Chenango County: Be it remembered that on the sixth day of December, 1815 before me, John Tracy, Surrogate of said county, personally came Israel Brownell, a subscribing witness to the annexed written instrument purporting to be the last will and testament of Peter German, deceased. Who being duly sworn, said that he saw said Peter German sign and seal said written instrument and heard him publish the same as and for his last will and testament. That at the time of the execution thereof, he, the said Peter German was of sound mind, memory and understanding, and under no restraint, according to the best of the knowledge and belief of him, the said deponent. And that he together with Andrew Buchard and Nicholas Richer, all their names thereto as witnesses in the presence of the testator and at his request and in the presence of each other. Jn. Tracy Surrogate Chenango County: Be it remembered that on the thirteenth day of December 1815 before me, John Tracy, Surrogate of said county. Came Obadiah German, James German and Joshua Lamb, Executors of the last will and testament of Peter German, deceased.
