By the grace of God (illegible) in (illegible). To all to whom these results shall come or concern send greeting know ye that at the Town of New Berlin in the County in the Chenango on the twenty f__ day of June one Thousand eight hundred and twenty before Nathan Chamberlin Esquire Surrogate of our said County the last will and Testament of Thomas Sarle deceased (a copy which as is here unto anounced) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods and chattels or credits within this State by means whereof the proving and registring the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the amount thereof doth belong unto us the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Thomas Sarle Junior and Elisha Sarle Executors the said Will named they being first duly sworn well and faithfully to administer the same and to make and Exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to (illegible) a just and true account thereof when them unto Required in Testimony where of we have caused the seal of the office of and said surrogate to be hereunto affixed Witness Nathan Chamberlin Esquire Surrogate of the said County at the Town of Norwich (?) aforesaid the twenty fourth day of June in the year of our Lord One thousand eight hundred and twenty and of our Independence ever the forty fourth. N. Chamberlin Surrogate In the name of God Amen This twenty ninth day of August in the year of our Lord one thousand eight hundred and seventeen Thomas Sairl of the town of New Berlin in the County of Chenango and State of New York Being sick in body but of a sound mind and memory and knowing that it is appo(illegible) for one to die do make and ordain this to my last will and testament. Principally and first of all I commit my soul with the hands of God that (illegible) and my bodily (illegible) in a decent and Christian Manner at the discretion of my Executors herein after named and as touching such worldly Estate as it hath please God to bless me with in this like I give and dispose of in the following manner. I give and bequeath unto my beloved wife Temperance Sairl the use and proffits of one third part of all my estate during her natural life and my Real Estate I dispose of as follows. I give and bequeath unto my beloved daughter Phebe Mulwain and to his Heirs forty two acres of Land being the west part of a certain tract of Land to me deeded by George Pomeray and lying in the Town and County of Otsego Commonly called the Babelstown purchase __________. Item: I give and bequeath unto my beloved son Thomas Sairl Jr. the one half of all my land situated in the Town of New Berlin in the County of Chenango on lots number sixty five and sixty six in the sixteenth Township to be the North half divided on a straight linefrom East to West threw the Center and also to have the priviledge of living in the Mulwain house until he can build on his own land and to have a priviledge in orchard and also forty acres of Land it being the East and remaining part of the above described lot in Otsego given to Phebe Mulvain under this condition that he shall convey by deed the same unto Alexander Mulwain if he shall pay to the remainder of the money due by contract by me made with the said Mulwain________. Item: I give and bequeath unto my beloved son Elisha Sairl the South half of all my land situated in the town of New Berlin and lots number sixty five and sixty six afore said mentioned. Item: my personal estate after my debts are discharged I give and bequeath unto my beloved daughter Amy Waterbury one hundred dollars---------------. Item: After the decease of my beloved wife Temperance I give and bequeath unto my beloved daughter Phebe Mulwain and Amy Waterbury all my household furniture of every kind to be equally divided between them to them their Heirs and Assigns forever, and to my sons Thomas and Elisha Sairl, I give unto each of them a feather bed and a good set of covering. Therefore and all legaces to be paid by my Executors named within one year after my decease and the remainder of all my property all my Ban(?) notes Book accounts hier (illegible) farming utensils and or I give equally between my beloved sons Thomas Sarle Jun. And Elisha Sarle and I do by hier by nominate and appoint my beloved sons Thomas (one more line illegible on this page) Last will and testament I do hereby disannul (?) and make said all (illegible) me hereto fore made and I do Ratify this to be my last will and testament in Witness I have hereunto set my hand and seal the day and year above written signed sealed published proscribed and declared to be the last will and testament of the said Thomas Sairl by him the said Thomas Sairl in the Presents of us who have subscribed our names as witness in the presents of the testator. Note before signing I give my Clock and desk to my son Elisha Saril. Thomas Sarl Barnabas Brown Asa Angel Ebenezer Ross Chenango County Be it remembered that on the twenty fourth day of June 1820 before Nathan Chamberlin Surrogate of said county came Barnabas Brown one of the subscribing witnesses to the forgoing instrument in writing who being sworn said that he saw Thomas Sarle sign and deal said instrument in writing and heard him publish and declare same as and for his last will and testament that at the time of the Execution thereof he the said Thomas Sarle was of a sound mind memory and understanding and under no restraint accoring to the best of his knowledge and belief of him this desouant(?) and that he this desanant(?) set his name to the said instrument together with Asa Angel and Ebenezer Ross all in the presence of the testator at his request and the Presence of Each other.
