Ogden. In the name of God, Amen. I Hannah M. Randall, widow of John Randall deceased of the town of Norwich in the County of Chenango and State of New York, being weak in body but of sound mind and memory for which blessed be Almighty God, calling to mind that all must die and being admonished by increasing years & infirmities to prepare to go hence forever do make, ordain and publish this my last will and testament in manner following, to wit. 1st I direct that my body be decently intered [sic] with Christian rite and ceremonies. 2nd I direct my Executor hereinafter named to pay and discharge all my just debts, including funeral charges. 3rd I give and bequeath unto Wealthy A. Randall wife of William Randall of North Stonington, my gold beads & locket, and my best bed and the furniture of the same. 4th I give and bequeath unto Eunice Coates wife of Anson Coates my silver table spoons. 5th I give and bequeath unto Hannah M. Avery the sum of one hundred dollars, to be paid by my Executor within one year after my decease. 6th I give and bequeath unto Hannah M. Randall daughter of William & Wealthy Randall, fifty dollars and my silver tea spoons. 7th I give and bequeath unto Albert G. Randall son of Frances P. Randall deceased, one hundred dollars. 8th I give and bequeath unto Wealthy A. Randall and Eunice Coates herein before named, & to the three daughters of my deceased brother Stephen Avery or to such of them as are living at the time of my death, to be equally divided according to the judgment & determination of my Executor all my wearing apparel, beds & bedding not before mentioned, table linen, tables, chests, glasses, couch and all other articles of furniture. 9th I give and bequeath to the Trustees of the Second Baptist Church in the village of Norwich in the County of Chenango & to their successors in office, the sum of one hundred dollars to be by them vested in a permanent fund for the benefit of said church & not to be diverted to any other use or purpose. 10th I give and bequeath unto Roswell R. Avery of Norwich aforesaid the sum of three hundred dollars. 11th I hereby give and bequeath unto Charles York of Norwich aforesaid the rest and residue of my estate, to be kept and retained by him as some compensation for his trouble in carrying into effect the provisions of this will. 12th I hereby nominate and appoint Charles York aforesaid, Executor of this my last will and testament, to be paid for his services as I have before specified all sums of money by me bequeathed to be paid by my Executor within one year after my decease. In witness whereof I have hereunto set my hand & seal this twenty third day of September one thousand eight hundred and thirty seven. Hannah M. Randall Signed, sealed and published by the Testatrix, to be her last will and testament, in the presence of us who at her request and in her presence and in the presence of each other, have subscribed our names as witnesses. John Blivin, Norwich Chenango County William Snow, Norwich Chenango County, N.Y. At a Surrogates Court held at the Village of Oxford in the county of Chenango on the 29th day October 1838 before Samuel McKoon Surrogate of the said County for the purpose of proving and recording the last will and testament of Hannah M. Randall late of the town of Norwich in the said county of Chenango, deceased which relates to personal estate only in pursuance of Chapter 6 Title first article first part second of the Revised Statutes of the State of New York and the acts of the Legislature of the State of New York amending the same on the application of Charles York an Executor in the said will named before Samuel McKoon Surrogate. On the day and at the place aforesaid the said Charles York, the Executor in the said last will named appeared for the purpose of proving said will and no one appearing for the heirs and next of kin, I the said Surrogate proceeded to hear the proof and allegations of the said Executor and thereupon the said Charles York produced satisfactory proof of the lawful service of the citations issued in this cause upon all the heirs and next of kin of the said deceased to wit: personal service upon Elijah Lewis special guardian of Erastus Avery & Frances Avery & Christopher Avery on the 18th day October 1838 & upon Stephen L. Avery, Roswell Avery, Cyrus Avery & Hannah M. Avery on the 20th day of October 1838 by showing to each the citation issued in this cause and the seal and by delivering to each of them a copy of the said citation and that the said Executor served the same upon Nathan Avery, Ralph Avery, Luther Avery, Lucy Avery, William Randall, Wealthy Randall, Ansel Coates, Eunice Coates, Adaline Park, Griswold Avery, & William Avery by putting letters containing copies of the said citation into the post office at Norwich directed to each of them at their places of residence on the fifth day of September 1838. And upon Alexander Avery by depositing a copy of the said citation in the post office at Norwich directed to him at his place of residence in Georgia on the 11th day of September 1838 and that a copy of the said citation had been duly published in the Albany Argus for six weeks successively previous to the 29th day of October 1838. Whereupon the said Executor produced the subscribing witnesses to said will who were by the said Surrogate sworn and testified as follows: John Blivin of the town of Norwich in the County of Chenango one of the subscribing witnesses to an instrument in writing purporting to be the last will and testament of Hannah M. Randall late of Norwich in said county deceased being first duly sworn doth depose and say that he was well acquainted with Hannah M. Randall of the Town of Norwich aforesaid, the testatrix in the last will and testament here in court produced and shown to this deponent, and who is now deceased, that he saw the said Hannah M. Randall, the said Testatrix sign her name to the said will and heard her at the same time declare the same to be her last will & testament. That William Snow, the other subscribing witness was present at the time the said Testatrix executed her said will as aforesaid, and that as well he the said John Blivin, as the said William Snow, subscribed their names as witnesses to the execution of the said will at the request of the said Testatrix in her presence and in the presence of each other and that the said Testatrix at the time she executed the said will as aforesaid was over twenty one years of age of sound mind memory and understanding and not under any restraint to his knowledge and belief. John Blivin Subscribed and sworn this 29th day of October 1838 before me Samuel McKoon, Surrogate. William Snow of the town of Norwich in the County of Chenango one of the subscribing witnesses to an instrument in writing purporting to be the last will & testament of Hannah M. Randall late of the town of Norwich aforesaid now deceased being duly sworn doth depose and say the he was well acquainted with Hannah M. Randall late of the town of Norwich in said county, the Testatrix in her last will & testament here in court produced and shown to this deponent and who is now deceased, that he saw the said Hannah M. Randall the said Testatrix sign her name to the said will and heard her at the same time declare the same to be her last will & testament that John Blivin the other subscribing witness to the said instrument in writing was present at the time the said Testatrix executed her said will as aforesaid and that as well he the said William Snow as the said John Blivin subscribed their names as witnesses to the execution of the said will at the request of the said Testatrix in her presence and in the presence of each other and that the said Testatrix at the time she executed the same was over 21 years of age, of sound mind, memory and understanding and not under any restraint to his knowledge or belief. William Snow Subscribed and sworn this 29th day of October 1838 before me Samuel McKoon, Surrogate. John Clapp of Norwich in Chenango County being first duly sworn doth depose and say that he was well acquainted with Hannah M. Randall late of Norwich in said County now deceased, that he at her request wrote her last will and testament now produced in court and shown to this deponent and that after it was executed by the said Testatrix and signed by the subscribing witnesses thereto the said Hannah M. Randall delivered the said will to this deponent for safe keeping and that he this deponent kept the same until after the decease of the said Testatrix in his possession sealed up and that after her decease he delivered the same to Charles York the Executor in the said will named. And this deponent further says that since the execution thereof there has been no alteration made in the contents of the said will and further says not. John Clapp Subscribed and sworn this 29th day of October 1838 before me Samuel McKoon, Surrogate. The foregoing proofs and examinations were taken before me the Surrogate aforesaid on the 29th day of October 1838 at my office in the town of Oxford aforesaid and the depositions of John Blivin & William Snow the only subscribing witnesses to said will as well as the deposition of John Clapp were by them respectively subscribed after having been first carefully read over to them and I the said Surrogate being satisfied upon the said proof before me taken as aforesaid, that lawful service of the citation issued in this cause had been made upon all the heirs & next of kin of said deceased and that due publication of the said citation had been made in the State paper for six weeks successively that the said will was duly executed and that the said Testatrix at the time of executing the same was in all respects competent to devise real estate and give and bequeath personal estate and not under any restraint do therefore allow the said will, proofs & examinations to be recorded.
