Present, M.G. Prindle Surrogate. In the Matter of Proving the Last Will and Testament of Thomas Havens Deceased. William M. Stineburgh the Executor. On the day, and the place aforesaid, named in the last Will and Testament of the said Thomas Havens deceased, appeared before said County Judge, acting as Surrogate, and offered the said last Will and Testament for proof and probate, as a Will of real and personal estate; and no one appeared to oppose such proof and produced satisfactory proof, by affidavit, of the due service of the Citation heretofore issued in this matter, requiring the ___ heirs at law and next of kin to the said deceased, to attend such proof and probate on this days as follows: ? service on Charles Havens, Jefferson Havens, Sally Havens Adaline Snow, Catherine Stineburgh, Olive Hitchcock, Lydia Masten (sp?) and Charlotte Glynn on the 13th day of June 1864 all in the County of Chenango Except Charlotte Glynn in the County of Madison And Welcome Havens generally the 13th day of June 1864 at Caroline, Tompkins County N.Y. And ? Lester(?) Rickard, Nis?? Ricakrd and ? LeRoy Rickard whose residence is unknown and cannot after diligent inquiry be ascertained by publication in the Albany Evening Journal the State paper once in each week for six weeks successively commencing on the 28th day of April 1864. And thereupon the said Executor of the said last Will and Testament, by the subscribing witnesses thereto, to wit: Chenango County, Francis E. Dommick of the town of Smyrna in said County, being duly sworn and examined before M.G. Prindle County Judge of said County, acting as Surrogate thereof, doth depose and say the he was well acquainted with Thomas Havens, now deceased; that he was present as a witness, and did see the said Thomas Havens subscribe his name at the end of the instrument in writing, now produced and shown to the deponent, bearing date the 6th day of April, in the year one thousand eight hundred and sixty three, purporting to be the last Will and Testament of the said Thomas Havens Deceased; that said Thomas Havens, at the time of making such subscription, declared accordingly did sign his name as a witness, at the end of the said instrument. This deponent further says, that the said Thomas Havens at the time he so executed the said instrument, was a citizen of the United States, of full age, of sound mind and memory, in all respects competent to devise real estate, and not under any restraint, and the this deponent saw ? ? , the other subscribing witness to said instrument, sign the said instrument at the end thereof, as a witness, in the presence of the said Thomas Havens and at his request. I Thomas Havens aged 64 years of Ostelic Chenango County and State of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament that is to say: First after all my lawful debts are paid and discharged I give and bequeath unto my two sons Charles Havens and Jefferson Havens all of my Estate both Real and Personal of whatever name or nature that I shall be possessed of at my decease to be divided equally between them to share and share alike I hereby appoint my Executor hereinafter named Trustee of the Estate of my son Charles Havens hereby authorizing and assigning him as such Trustee to take charge of all such ? of my Estate as is ? given to him. And to take care of, manage and improve the same to the best advantage and to ?? to him from time to time and ?? for his support and maintenance such such ?????his said Trustee shall deem necessary for a proper support of the said Charles as his necessities may reasonably be ? Likewise I make, constitute and appoint William Stineburgh to be Executor of this my last Will and Testament hereby making all former Wills by me ? In witness whereof I have hereunto subscribed my name and affixed my seal the sixth day of April in the year of our Lord one thousand eight hundred and sixty three, Ss/ Thomas Havens w/seal Chenango County SS: I hereby certify that the foregoing is a correct Record of the last Will and Testament of Thomas Havens deceased and of the Proofs thereof and that said Will and Proofs have been Recorded this 30th day of June 1864. Prindle, County Judge of said County, acting as surrogate thereof doth depose and say that he was well acquainted with Thomas Havens, now deceased; that he was present as a witness, and did see the said Thomas Havens subscribe his name at the end of the instrument in writing, now produced and shown to this deponent bearing the date the sixth day of April, in the year one thousand eight hundred and sixty three, purporting to be the last Will and Testament of the said Thomas Havens, deceased; that the said Thomas Havens, at the time of making such subscription, declared the said instrument his last Will and Testament and requesting this deponent to sign his name as a witness thereto; that thereupon this deponent accordingly did sign his name as a witness as the end of the said instrument. This deponent further says that the said Thomas Havens at the time he so executed the said instrument was a citizen of the United States , of full age, of sound mind and memory, in all respects competent to devise real estate, and not under any restraint , and that his deponent saw F.E. Dimmick, the other subscribing witness to said instrument, sign the said instrument at the end thereof, as a witness, in the presence of the said Thomas Havens, at his request.
