Will of Dietz, Malcom G., Chenango Co. ,Sherburne, N.Y.

I Malcom G. Dietz of the town of Sherburne,county of Chenango,state of New 
York, being of sound mind and memory do make, ordain, publish and declare this 
to be my last Will and Testament that is to say:     

First: After all my lawful debts are paid and discharged,I give,demise and
bequeath to my dear wife Ida R. Dietz, all my real and personal estate of
every name and nature and kind whatsoever for her own use forever. Likewise,I
make constitute and appoint my wife to be sole Executrix of this my last Will 
and Testament,hereby revoking all former Wills by me made. In witness
whereof,I have hereunto subscribed my name and affixed my seal the 4th of
September in the year of our Lord one thousand, eight hundred and eighty two.

The above instrument consisting of one sheet,was at the date thereof
subscribed by Malcom G. Dietz in the presence of  us and each of us, he had at
the time of making such subscription, acknowledged that he made the same and
declared the said instrument so subscribed by him to be his last Will and
Testament wherein from me then and there, at his request and in his presence
and the presence of each other, inscribed our names as witnesses thereto. 
Signed Lyman Brown, Issac Plumb, Both residing at Sherburne N.Y.

At Surrogate's court, held at the village Norwich and county of Chenango, on
22 nd day of January 1884 ,Present Hon W.F. Jenks surrogate. In the matter of
the last Will and Testament of Malcom G. Dietz. On the day,and at the place 
aforesaid, Ida R. Dietz Exectrix named in the last Will and Testament of
Malcom G. Dietz deceased, appeared before the county Judge, acting as
surrogate, and offered the last Will and Testament for proof and probate.The
proofs offered of the manner of the service of citation by Emma A. Dietz, Eva
G. Dietz, Emma Walker, Irwin Dietz, Mary E.Read, and Nettie Dietz, date
November 29, 1883 and of personal service upon Phineas G. Dietz November 28,
1883.
