Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ****************************************************************** Transcribed from the original court document, preserving spelling, punctuation, & syntax, by Jan Wilson Ramos, 10/22/98 (RamosGang@Worldnet.att.net) JOHN WILSON Clinton Co. ss Be it remembered That on 29th day of October 1894 The last Will and testament of John Wilson late of Plattsburgh in said County deceased, was duly admitted to Probate by the Surrogate of said County and by him adjudged to be a valid will of both Real and Personal Estate and ordered to be recorded with the proofs taken in respect unto which said last Will and testament and the Proofs and Examinations are hereby recorded as follows that is to say: WILL I John Wilson of Plattsburgh Clinton County New York being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament, that is to say: First: After all my lawful debts are paid and discharged, I give, devise and bequeath unto my beloved wife Catherine E. Wilson the use, occupation, and control during her natural life of all my real property of every nature & wherever situated and at the death of my said wife I give, devise and bequeath all my said real property to my son Charles Wilson in fee. Second: I give devise and bequeath to my son William one cow: and to my son John, one cow, said cows to be delivered to them immediately after my death. Third: I give devise and bequeath to my said wife the use occupation and control during her natural life of all my personal property of every nature and wherever situated: and at her death said property I give and bequeath to my said son Charles, subject however to the bequests herein named. Fourth: I give and bequeath to each of my children William, John H., Frank, Mary Jane, Edward L. the sum of fifty dollars to be paid to them respectively when they become of age without interest, and I hereby make the payment of said legacies a charge and lien whom my said real property, and direct the payment of the same by my said son Charles. The above provisions for my said wife in lieu of dower and all other rights and claims she has or may have in or against my estate. Likewise, I make, constitute, and appoint my said wife Catherine E. Wilson to be Executrix of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal the 21st day of September in the year one thousand eight hundred and ninety four. Whereupon We here and there at his request, and in his presence and the presence of each other, subscribed our names as Witnesses hereto: Julius Ruger residing at Plattsburgh NY Charles McMasters residing at Plattsburgh, NY PROOFS Surrogates Court - Clinton County, New York In the matter of the Probate of the last Will and Testament of John Wilson Late of Plattsburgh in said County of Clinton deceased Examination of Witnesses taken in open Court before John H. Booth, Surrogate of Clinton County NY State of New York Clinton County Charles McMasters and Julius Ruger of Plattsburgh NY being each first duly sworn and examined in open Court on their oaths do depose and say that they were personally acquainted with John Wilson deceased, that they are subscribing witnesses to the last Will and testament of John Wilson deceased, and these deponents further say that the said deceased did in the presence of these deponents, subscribe his mark at the end of the instrument which is now here shown to these deponents and offered for probate and purporting to be his last Will and Testament and bearing date on the 21st day of September 1894; that the said deceased at the time of so subscribing his name to the said instrument did declare the same to be his last Will and testament; that these deponents did thereon subscribe their names at the end of the said instrument as attesting witnesses to the execution thereof, at the request of the said deceased, in his presence and in presence of each other; that the said deceased at the time of so subscribing his name thereto was a citizen of the United States upward of twenty-one years of age, and that he appeared to be of sound mind, memory and understanding, and was not under any restraint to the knowledge or belief of these deponents. Booth Surrogate Clinton County ss In appearing from the proofs and Examinations taken in respect to the Last Will and testament of John Wilson Late of Plattsburgh in said County deceased, that the said Will was duly executed by the said deceased, and that at the time he so executed the same he was in all respects competent to devise Real Estate and not under restraint; that the said Will is a valid Will of both Real and Personal Estate and that the Proofs are sufficient, the said Last Will and testament and Proofs and Examinations are hereby recorded, signed and certified, pursuant to the Statutes in such cases made and provided this 29th day of October 1894: John H.
