Chas. Esselstyn, Surrogate Columbia County, SS: Be in remembered, that heretofore, to wit, on the second day of October, in the year One thousand Eight hundred and Sixty, C. M. Punderson and J. M. Punderson, the sole Executrix and Executor, named in the Last Will and Testament of Frank Punderson, late of the City of Hudson, deceased, appeared in open Court, before the Surrogate of the County of Columbia, and made application to have the said Last Will and Testament, which relates to both Real and Personal Estate, proved; and on such application, the Surrogate did ascertain, by satisfactory evidence, who were the Widow, heirs and next of kin of the said Testator; and their respective residences; and said parties interested in this said matter, to wit, the said Widow, heirs at Law and next of Kin, on the said second day of October, One thousand Eight hundred and Sixty, produced and presented to said Surrogate a certain Instrument in writing signed by said Widow and Heir at Law, and whereby they waived the issuing and service upon them of a citation to attend the probate of the Last Will and Testament of said Frank Punderson deceased, and praying that the immediate examination of witnesses in this matter be proceeded with; And afterwards to wit on the said second day of October, no one appearing to oppose the probate of the said Will, such proceedings were thereupon had afterwards, that the Surrogate took the proof of said Will hereinafter set forth upon this second day of October in the year One thousand Eight Hundred and Sixty, and he adjudged the said Will to be a Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs are as follows that is to say, To all whom it may concur, know that, I Frank Punderson of the City of Hudson, County of Columbia, State of New York, being in the Sixty Third year of my age and of sound mind, deem it proper to make known my Will for the disposition of my property, after my natural death. After the payment of the Funeral expenses according to the manner directed and hereunto appended, - I give and bequeath unto my Wife Caroline Marion all my property, personal and real in fee, during her natural life, directing that at her death she leave and give all, to the Children of my Son James Mellen Punderson. And I hereby appoint my Wife Caroline Marion [page 632] Executrix, and James Mellen Punderson my Son Executor to this my Last Will and Testament - in witness whereof I hereunto set my hand and seal this eighteenth day of September, One Thousand Eight hundred and Sixty. The word “property”, on the fifth line and the word “directing” interlined in the Eighth line was done before signing. Funeral to be without any parade, in a simple manner according to the Church service. Coffin to be made of Hard Sound Mahogany, without a single ornamental knob, screw, handle, plate, embellishment whatever. My corpse to be laid out in a plain white Robe, without any flowers, evergreens, or anything of the kind. If the season and weather is suitable would like to have the Grave to be prepared before interment, as follows: The box to be placed in the grave, a brick wall, laid in cement on each side and the foot, four inch above the top of the Box when closed, flat stones provided to cover the whole, a light stone wall at the head to be carried up to the surface for a foundation to a plain head stone, but if weather or season prevent, then to have it done as soon after as may be. Columbia County SS: Edmund Holley of the City of Hudson of the County of Columbia being first duly sworn deposes and says that he is a subscribing witness to the Instrument now shown to him and purporting to be the Last Will and Testament of Frank Punderson deceased, and bearing date on the eighteenth day of September in the year of our Lord, one thousand Eight hundred and sixty. That the deponent and Philo Plank and Allen Rockefeller the other subscribing witnesses signed their names as witnesses to said Instrument, at the request and in the presence of the said Frank Punderson and in the present of each other. That the deponent saw the said Frank Punderson execute the said Instrument, and heard him declare the same to be his Last Will and Testament, at which time the said Frank Punderson was of sound and disposing mind and memory, of full age, and not under any restraint according to the deponent’s best knowledge and belief. That the said Frank Punderson is now dead, and died at the City of Hudson on the 27th day of September Eighteen hundred and Sixty, and was at the time of his death an inhabitant of the City of Hudson in the County of Columbia.
