In the name of God Amen. This sixth day of April in the Year of our Lord one thousand seven hundred and ninety two I Johancrist Wagnenaer of Claverack in the County of Columbia and State of New York Yeoman being in perfect health, mind and memory praised be God for the same. And calling to mind the mortility of my Body, do make and ordain this to be my last Will and Testament in manner and form following, that is to say, first I recommend my soul to Almighty God, who gave it, hoping thro the merits of our Saviour Jesus Christ to have pardon of all my sins and my body to the Earth from whence it came, to be buried in a decent and Christian manner at the discreation of my Children in the hopes of a Joyful Resurrection and touching my temporal Estate, both real and personal, I give, devise, bequeath and dispose of the same in manner and form following - Imprimus, It is my will and I do order that all my just debts and funeral charges shall be paid and satifyed out of my personal Estate Item, I give and bequeath unto my eldest son Johannis Wagenaer the sum of twenty shillings new york currancy for his birthright as being my eldest son. Item I give, devise and bequeath unto my son Jacob Wagenaer and to his heirs and assigns forever, the house, barn, barricks and other buildings where I now dwell and so much of the ground on which the same is Erected as he shall want for a Homestead to the same upon condition that he shall allow unto my son Matthias Wagenaer and to his heirs and assigns forever just so much ground for his homestead [and] building where he now dwelleth. Item, I give, devise and bequeath unto my said two Sons namely Matthias and Jacob and to their respective heirs and Assigns forever All and singular the remainder of my real Estate with every part and percil thereunto belonging on in anywise apportaining to be by and between them or their respective heirs as Assigns equally divided and possessed share and share alike upon condition and I do hereby will and order that my said two Sons namely Matthyas and Jacob or their respective heirs or Assigns shall pay or cause to be paid to seven of my Children and one Grand Child the sum of two hundred and ten pounds, that is Matthius or his heirs to pay one hundred and five pounds and Jacob or his heirs one hundred and five pounds New York currancy namely to Johannis Johan Adam, Hannah, Margaret, Gertrude, Mary Catharine and my Grandson Henry Blunt to be equally divided by and between them or their respective heirs as Assigns share and share alike it being in lieu of the horse paid to the Patron for Land bought of him. Item, I give and bequeath all and singular the remainder of my personal Estate what is not herein before given and bequeathed unto all my before mentioned Children and GrandSon namely to Johannis, Johan Adam, Matthias, Jacob, Hannah, Margaret, Gertrude, Mary Catharine and Henry Blunt to be equally divided by and between them or their respective heirs or Assigns share and share alike And ___ I constitute and [several words unreadable] Johannis and Matthias Wagneaer and my trusty Son in Law Killeyaen Smith Executors of this my last will and Testament. In Testimony whereof I have hereunto set my hand and seal the day and year first above written his Johancrist X Wageneaer [[L.S]] Signed sealed published and mark declared by the said Johancrist Wagenaer to be his last Will and Testament in presence of William H. X Clapper his Simeon SS Shutts David Brouwer mark Columbia ss. Be it Remembered that on the Eighth day of July in the year of our Lord 1796 David Brouwer and William H Clapper of the County of Columbia Appeared before me Philip L Hoffman Surrogate of the said County and being duly sworn say that they saw Johancrist Wagenaer sign and seal the within Instrument Instrument [sic] purporting to be the last will and testament of the said Johancrist and heared him publish and declare the same as and for his last will and testament that at the time of executing thereof he the said Johancrist was of sound and disposing mind and memory to the best knowledge and belief of the Deponants, and that Simeon Shutts and the Deponants severally subscribed their names as witnesses to the said Will in the presence of the Testator. Be it also remembered that on the said 8th day of July in the said Year of our Lord 1796 Matthias Wagenaer one of the executors named in the within will appeared before me and ____ the 11th day of the same month Killeyaen Smith [an executor?] in the said will named also appeared before me and were severally sworn to the true execution and performance of the said will by taking the Oath by Law appointed. Know ye that at Livingston in the County of Columbia the day on the Eighth day of July Instant before Philip L Hoffman Esq. Surrogate of the said County, the last will and testament of Johancrist Wagenaer deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death, goods chattels or credits within this State, by means whereof the proving and registering the said will, and the grating [sic] administration of all and singular the goods chattels and credits and also the auditing, allowing and final discharging the account thereof doth belong unto us the Administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Mathias Wagenaer and Killeyaen Smith two of the Executors in the said will named, they being first duly sworn well and faithfully to administer the same, and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed.
