Registered this 16th day of November 1801 In the name of God Amen I Johannis Milhen of the Town of Claverack in the County of Columbia and State of New York Farmer being sick and weak in body but of disposing mind & memory Blessed be god for the same do make publick proclaim and ordain this my last will & testament in manner following ) I recommend my soul into the hand of Almighty God that gave it and my body to the Earth to buried in a decent manner at the discretion of my Executors and as [touching] my worldly estate where with it has pleased God to bless me in this life I give devise and dispose of the same in manner [?] following First - I give and bequeath to [Ana?ie] my dearly beloved Wife the sole use and right to all my Estate Real and Personal during her natural life or untill her marriage 2nd - After the death or remarriage of my said Wife [Anatie] I do order and ordain that all my personal estate shall be equally devided between my four children Johantice, Jacob, Margaret, and [Anatie] 3rd - After the death of my said Wife [Anatia] then all my real estate to be equally devided between my two sons Johantice & Jacob 4th - I do order and direct that my two sons Johantice & Jacob pay unto my afoursaid Daughters Margaret & [Anatic] the sum of two hundred dollars within [ten] days after the death of my said Wife [Anatie] 5th - I order and direct that my said Daughters Margaret & [Anatie] [?] [?] [?] [?] [?] [?] until their marriage or deaths - And Lastly I do [constatute] ordain & appoint my two sons [Johantice] Milhen & Jacob Milhin my Exe[cutors] of this my last Will & Testament and I do hereby [?] disallow and [revoke] all former Testaments by me made - In [Witness] where of I have [herewith] [set] my hand & seal this fourth day of August in the year of our Lord one thousand eight hundred [?] his mark John Milhen Signed Sealed Published & Declared by the said Johannis Mil[?] as his last Will & Testament in the presence of us I, Dwight Mouell Jeremiah [Fonda] George Mouell - Columbia County [?]- Be it Remembered that on the said sixteenth day of November in the year of our Lord one thousand eight hundred & one George Mouell of the town of Claverack in the County of Columbia aforesaid personally appeared before me William W [Van Ness] Surrogate of the said [County] and being duly sworn says that he saw Johannis Milhen sign and seal the above Testament purposting to be his last Will and Testament and heard him publish and declare the same as [?] for his last Will and Testament, That at the time of executing thereof he the said Johannis was of sound disposing mind and memory ccording to the best of the knowledge and beleif of this Depo[???] And that this [Deponent] and Joseph Dwight Mouell and Jeremiah Fonda severally subscribed their names as Witnesses to the said Will in presence of the [Testator] [WW Van Ness] Columbia County [?] Be it also Remembered that on the said sixteenth day of November in the year of our Lord one thousand eight hunddred and one Johantice Mil[hen] & Jacob Milhen the Executors in the said Will named personally appeared before me William W Van Ness Surrogate of the said County and were duly qualifyed to the [true] perfor[mance] and execution of the said Will by taking the oth by law appointed W W Van Ness The People of the State of New York by the grace of God Free and Independent [?] to whom these [Presents] shall come or may [cometh] [?] {Greeting. Know Ye that at Claverack in the County of Columbia and State of New York on the day of the date hereof before William W Van Ness Esquire Surrogate of our said County the last Will and Testament of Johannis Milhen Deceased / a copy whereof is hereunto annexed ) was proved and is now approved and allowed [of] by us, and the said Deceased having whilst he lived and at the time of his death goods chattles or credits the proving [?] is [having] the said Will & granting [administration] of all and singular the said goods chattles & credits and also the crediting allowing [?] [?] [charging] [account] [the] [?] [doth] [before] [?] us within this state by means whereof The administration of all and singular the said goods & chattles rights and credits of the said Deceased and any way concerning his Will is granted unto Johantice Milhen & Jacob Milhen the Executors in the said Will named they being first duly sworn well and faithfully to administer the same and to make aand exhibit a true and perfect Inventory of the said goods chattles and credits. And also to [render] a just and true account thereof when there unto required. In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. W W Van Ness Additional Comments: I find only one Milham / Milhen etc...Line in Claverack- John Tice Milham 1800 census (next door to John) and then only Mathias 1810,20,30,50. He was Bapt. in St. Pauls (Red Hook0 to Johannes Milhen and Anna Wagener. Bapt. in Reformed ch. Claverack , children to both John Teis (many spellings) Milham (many spellings) and Gertruy Diedrich and Mathias (many spellings)Milham (mny spellings) and Gertruy Diedrich.
