Recorded June 4th A.D. 1858. State of New York Ls. Columbia County Be it remembered that heretoforth to wit on the twenty fifth day of May A.D. 1858 William H. Hover one of the executors named in the Last Will and Testament of Jonas Hover, late of the town of Taghkanic, in said County of Columbia, deceased, appeared in open Court before the Surrogate of the County of Columbia and made application to have the said Last Will and Testament which relates to real and personal estate, proved; and on such application the Surrogate did ascertain by satisfactory evidence, who were the widow, heirs and next of kin of the said Testator and their respective residences, and some of them appearing to be minors, and having no General Guardian residing within the State of New York, a Special Guardian was appointed in due form of law, to take care of their interests in the matter of proving the said Will, by an order entered for that purpose by said Surrogate; and said Surrogate did thereupon issue a citation in due form of law directed to the said Widow, heirs and next of kin and Special Guardian by their respective names, stating their respective places of residence - requiring them to appear before said Surrogate, at his office in the City of Hudson in said County, on the fourth day of June then next to attend the probate of said Will; and afterwards, to wit, on the said fourth day of June satisfactory evidence by affidavit was produced and presented to said Surrogate, of the service of the said citation in the mode prescribed by law and on that day no one appearing to oppose the probate of such Will, such proceedings were thereupon had afterwards, that the Surrogate took the proof of said Will hereinafter set forth upon this fourth day of June one thousand eight hundred and fifth eight, and he adjudged the said will to be a valid Will of real and personal estate, and the proof thereof to be sufficient, which said Last Will and Testament, and proofs are as follows, that is to say ____ In the name of God Amen. I Jonas Hover of Taghkanic do make and declare this my last Will and Testament, in manner and form following, first I resign my soul into the hands of Almighty God hoping and believing in a remission of my sins by the merits and mediation of Jesus Christ, and my body I commit to the earth to be buried at the discretion of my executors hereafter named and my worldly estate I give and divide as follows. First I will and bequeath to my son Lathan Hover my real estate lying and being in the town of Tahgkanic and the place on which he now lives during his natural life. I also will and bequeath of my personal property to wife Catherine one thousand dollars for her support during her natural life, and after her death to be divided between my five living heirs William, Lathan, Betsy, Lany, Castina, share and share alike, and the remainder of my personal property I give and bequeath to my five living children share and share alike by my executors paying to my grandchildren of my son Peter Hover twenty-five dollars each when they become twenty one years of age and if one should die then to pay the survivors this last mentioned sum to be paid four years after my death by my executors to my five living children I further appoint William H. Hover and Lathan Hover my executors of my Last Will and testament. the written instrument consisting of half sheet was now and hereby subscribed by me Jonas Hover the testator in the presence of each of us and was at the same time declared by him to be his Last Will and Testament and we by his request sign our names hereto as testifying witnesses. his Jonas X Hover [[Ls]] mark Abraham Myers residing in Taghkanic, County Columbia Witness Elias Decker residing in Taghkanic County Columbia Sealed and delivered in presence of the above witnesses this March 3rd 1858. Columbia County Ls. Abraham Myers of the Town of Taghkanic in the said County being first duly sworn deposes and says that he is a subscribing witness to the Instrument now shown to him purporting to be the Last Will and testament of Jonas Hover, deceased, and bearing date on the third day of March in the year of our Lord one thousand eight hundred and fifty eight, that the deponent and Elias Decker the other subscribing witness signed their names as witnesses to said Instrument at the request and in the presence of the said Jonas Hover and in the presence of each other, that the deponent say the said Jonas Hover execute the said Instrument and heard him declare the same to be his last Will and Testament at which time the said Jonas Hover was of sound and disposing mind and memory, of full age, and not under any restraint according to the deponents best knowledge and belief, that the said Jonas Hover is now dead, and was at the time of his death an inhabitant of the Town of Taghkanic in the County of Columbia. Deponent further says that he wrote the said Instrument, after it was executed by said Jonas Hover, to be kept by deponent and that it has remained in his possession since the time of its execution until this day when presented to the Surrogate for proof, and that said Instrument is now in the same condition in all respects as when executed by the said Jonas Hover. Abraham Myers Sworn before me this 4th day of June 1858 R. B. Monell Surrogate Columbia County Ls.
