Lape, Taghkanic in the County of Columbia, New York Record of the last will and testament of Thomas J. Lape, late of the town of Taghkanic in the County of Columbia, deceased, relating to both real and personal estate and the proofs and examinations relating them- Recorded October 8th 1859- State of New York Columbia County Be it remembered that heretofore on this seventh day of September A.D. 1859- Anna Maria Lape, executrix named in the last will and testament of Thomas J. Lape, late of the town of Taghkanic in said County of Columbia deceased, appeared in open court before the surrogate of the County of Columbia, and made application to have the said last will and testament which relates to real and personal estate proved – and on such application, the surrogate did as certain by satisfactory evidence who were the widow, kins and rest of kin of said testator and their respective residences and some of them appearing to be minors and having no general guardian residing within the state of New York, a physical guardian was appointed in due form of law to take care of this interest in the matter of proving the said will by an order entered for that purpose by said Surrogate and said Surrogate did then … a citation in due form of law, directed to the said widow, kins and rest of kin and special guardian by their respective names, stating their respective places of residence requiring them to appear before said Surrogate at his office in the City of Hudson in said County on the eighth day of October satisfactory evidence by affidavit … to said Surrogate, of the service of the said citation in the prescribed by law and on that day no one appearing to oppose the probate of such will, such findings were therefore had, afterwards that the Surrogate took the proof of said will, hereinafter set forth, upon this eighth day of October, one thousand eight hundred and fifty six, and he adjudicated the said will to be a valid will of real and personal estate and the proof theretofore be sufficient – Which said last will and testament and proof are as follows that is to say: In the name of God Amen – I Thomas J. Lape of the town of Taghkanic in the County of Columbia and State of New York, of the age of fifty six, April last 1859, and being of sound mind and memory, do make, publish and declare this my last will and testament in manner following – that is to say. First. I give and bequeath to my wife Ana Mariah the whole of my real and personal estate after my debt is satisfied out of the property that is with one exception. I give to my daughter Elizabeth Ann Lape, the sum of twenty five dollars to have after she marries. Second - I give and bequeath to my son Henry Lape, the sum of twenty five dollars in one year from this date Third - I give and bequeath to my daughter Gertrude Christine, the sum of twenty five dollars, after she marries. 4th - I give and bequeath to my daughter Sarah Catherine Lape, the sum of twenty five dollars, to be paid in two years from this date without intent 5th - I give and bequeath to my son Jacob Lape the sum of $5 to be paid in two years from this date with intent 6th - I give and bequeath to my son Robert Alen Lape, the sum of five dollars to be paid in two years from this date without intent 7th - I give and bequeath to my son Smith Lape, the sum of ten dollars to be paid in two years from this date. 8th I give and bequeath to my daughter Margaret Janet, the sum of five dollars, to be paid in two years from this date 9th - I give and bequeath the sum of five dollars to be paid in two years from this date (sic) 10th - I give and bequeath to Gertrude Ophelia the sum of one dollar, to be paid in two years from this date 11th The property real and personal, I will to my wife, Anna Maria after the debts and the amounts specified above to each kin is taken out, according to the direction in the will and Lastly, I hereby appoint my wife Anna Maria and Martin Holsapple my executors to my last will and testament hereby making all former will by me made – In Witness Whereof I have hereto set my hand and seal this 6th day of July 1859 Thomas J. Lape (L.S.) The above instrument consisting of one sheet was at this date thereof declared to us by Thomas J. Lape the testator therein mentioned, to be his last will and testament, and he at the same time acknowledged to us and each of us, that he had signed and sealed the same and we therefore at his request and in his presence and in the presence of each other signed our names as attesting witnesses Witnesses James E.
