Recorded December 13th A.D. 1858 State of New York, Columbia County Be it remembered that herefore, to wit, on the fourth day of October AD 1858, Elizabeth A. Mosier, the administrator of Daniel M. Mosier deceased, who claimed to be a creditor of Eli Mosier, late of the City of Hudson in said County of Columbia, deceased, appeared in open Court before the Surrogate of the County of Columbia, and made application to have the said Last Will and Testament, which relates to Personnel Estate only, proved, and on such application the Surrogate did ascertain by satisfactory evidence, who were the Widows heirs and next of kin of the said Testator and their respective residences and some of them appearing to be minors and having no General Guardian residing within the State of New York, a special guardian was appointed in due form of law, to take care of their interests in written of proving the said Will, by an order entering for that purpose by the Surrogate; and said Surrogate did thereupon issue a citation, in due form of the law, directed to said Widow, heir and next of kin and special Guardian, by their respective names, stating their respective places of residence, requiring them to appear before said Surrogate at his office in the City of Hudson in said County on the twenty sixth day of November then next to attend the probate of said Will; and afterwards, to wit, on the said twenty sixth day of November satisfactory evidence by affidavit was produced and presented to said Surrogate of service of the said citations, in the mode prescribed by law, and on that day Stephen S. Magonn, as proctor for the said Elizabeth A. Mosier appeared in said manner, and present, the hearing in said matter was adjourned to the 13th day of December then next at ? o'clock in the forenoon, on which last mentioned day was one appearing to oppose the probate of such Will, such proceedings were there upon had afterwards that the Surrogate took the proof of said Will hereinafter set forth, upon this thirteenth day of December one thousand eight hundred and fifty-eight, and he adjudged the said Will to be valid Will of Personal Estate only and the proofs thereof to be sufficient; which said Last Will and Testament and proofs are as follows, that is to say: This is the Last Will and Testament of Eli Mosier of the City of Hudson in the County of Columbia and the State of New York. I, Eli Mosier, considering the uncertainty of human life, and being of sound and disposing mind, memory and understanding, do hereby make, publish and declare my Last Will and Testament in manner and from following, that is to say: First: I give and bequeath with my beloved wife Rebecca F. Mosier all my Personal Estate of whatever name or nature which I shall own or be possessed of at the time of my decease, To Have and To Hold the same to her, her executors, administrators and assigns forever. Lastly: I do hereby nominate and appoint my said wife Rebecca F. Mosier sole Executive of this my Last Will and Testament and hereby revoke all and every former Wills or Will by me made. In witness whereof I have herewith set my hand and seal the eighth day of April in the year one thousand eight hundred and fifty three. Eli Mosier Signed, sealed, published and declared by the said Testor Eli Mosier to be his Last Will and Testament in the presence of us who at his request, in his presence and in the presence of each other, have subscribed our names as witnesses. Sarah Stoddard and Darrius Peck of the City of Hudson in the County of Columbia, being first duly sworn, deposes and says, that s/he is a subscribing witness to the instrument now shown to her purposing to be the Said Will and Testament of Eli Mosier deceased, and bearing date on the eight day of April in the year of our Lord one thousand eight hundred and fifty-three, the deponentant Darius Peck / Sarah Stoddard, the other subscribing witness, signed their names as witness to said instrument at the request and in the presence of said Eli Mosier and in the presence of each other, that the deponent saw the said Eli Mosier execute the said instrument and heard him declare the same to be his Last Will and Testament at which time the said Eli Mosier was of sound and disposing mind and memory, of full age, and not under any restraint according to the deponents best knowledge and belief, that the said Eli Mosier is now dead and was at the time of his death an inhabitant of the City of Hudson in the County of Columbia.
