Be it remembered, that heretofore, to wit, on the eighth day of April A.D. 1858, Nancy Reynolds the widow and executrix named in the Last Will and Testament of Jonathan Reynolds late of the town of Chatham in said County of Columbia, deceased, appeared in open Court before the Surrogate of the County of Columbia, and made application to have the said last Will and Testament which relates to real and personal estate proved, and on such application, the Surrogate did ascertain by satisfactory evidence who were the heirs and next of kin of the said testator, and their respective residences, and said Surrogate did thereupon issue a citation, in due form of law, directed to the said heirs and next of kin, by their respective names stating their respective place of residence, requiring them to appear before said Surrogate at his office in the City of Hudson in said County, on the twenty seventh day of May then next to attend the probate of said Will; and afterwards, to wit, on the said twenty seventh day of May, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the service of the said citation in the mode prescribed by law, and on that day, no one appearing to oppose the probate of said Will, such proceedings were thereupon had afterwards, that the Surrogate took the proof of said Will hereinafter set forth, upon this twenty seventh day of May one thousand eight hundred and fifty eight, and he adjudged the said Will to be a valid Will of real and personal estate and the proofs thereof to be sufficient; Which said last Will and Testament, and proofs are as follows, that is to say. I Jonathan Reynolds of the town of Chatham, County of Columbia and State of New York, farmer of the age of fifty eight years, and being of sound mind and memory, do make, publish and declare, this my last will & testament in manner and form following, that is to say First - I give and bequeath to my wife Nancy all my property real & personal to her in [unreadable] forever subject to the support of my son Henry as hereinafter provided. Second - I give and bequeath to my son Henry Reynolds, his living and support & direct that the same shall be a tax during his life on my real estate. Lastly - I do hereby nominate and appoint my wife Nancy Reynolds, aforesaid and Elias Reynolds son of William L. Reynolds to be the executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this 31st day of December in the year of our Lord one thousand eight hundred and fifty seven. Jonathan Reynolds The above instrument in writing consisting of one sheet of paper was at the date thereof signed, sealed, published and declared by the said Jonathan Reynolds was & for his last will and testament in the presence of us, who at his request and in his presence and in the presence of each other, have subscribed our names as witnesses thereto Allen Reynolds Chatham Columbia Co N.Y Jonathan B. Rider Chatham Columbia Co N.Y. Columbia Court ss Jonathan B. Rider of the town of Chatham in the said County, being first duly sworn deposes and says that he is a subscribing witness to the instrument now shown to him purporting to be the Last Will and Testament of Jonathan Reynolds, deceased, and bearing date on the thirty first day of December in the year of our Lord one thousand eight hundred & fifty seven, that the deponent and Allen Reynolds the other subscribing witness signed their names as witnesses to said instrument at the request and in the presence of the said Jonathan Reynolds and in the presence of each other, that the deponent saw the said Jonathan Reynolds execute the said instrument and heard him declare the same to be his Last Will and Testament at which time the said Jonathan Reynolds was of sound and disposing mind and memory, of full age, and not under any restraint according to the deponent's best knowledge and belief. That the said Jonathan Reynolds is now dead and was at the time of his death an inhabitant of the town of Chatham in the County of Columbia. Deponent further says that he wrote the said Instrument and that it is now in all respects the same as when executed by the said Jonathan Reynolds. Sworn before me this Jonathan B. Rider 27th day of May 1858. R. B. Monell Surrogate Columbia Court ss Allen Reynolds of the town of Chatham in the said County, being first duly sworn deposes and says that he is a subscribing witness to the Instrument now shown to him purporting to be the Last Will and Testament of Jonathan Reynolds, deceased, and bearing date on the thirty first day of December in the year of our Lord one thousand eight hundred and fifty seven, that the deponent and Jonathan B.
