Punderson late of Columbia County deceased, as a Will of Real and Personal Estate, with the proofs taken in relation thereto. Recorded Oct 10th 1867 Be it remembered that heretofore to wit on the 10th day of October 1867, James M. Punderson the Sole Executor named in the Last Will and Testament of Caroline M. Punderson late of Columbia County deceased, appeared in open Court before the Surrogate of the said County and made application to have the Said Will, which relates to both Real and Personal Estate proved. And James M. Punderson appearing to be the only heir and Next of Kin of the Said Testatrix. And Praying for the immediate proof of Said Will. Such proceedings were thereupon had that the Surrogate took the proof of said Will hereinafter set forth upon this 10th day of October 1867 and he adjudged the Said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient which Said Will and proofs are as follows that is to say. The Last Will and Testament of Caroline Marion Punderson of the City of Hudson in the County of Columbia and State of New York. I Caroline Marion Punderson do make this [page 638] my Last Will and Testament in manner following: I appoint my Son James Mellen Punderson Sole Executor and Trustee of this my Will. All of my Estate both Read and Personal I devise and bequeath to my said Son James in Trust for the use and purpose following. That during the minority of the several children of my Said Son James, my said Trustee invest and keep invested my said Estate upon Interest and apply so much of the Interest and income arising therefrom as may be necessary to and for the education and maintenance of my grand-children until they shall severally attain the age of Twenty- one years. And such income and interest as shall not be required for that purpose I direct shall be added to the principal sum and accumulated. And as each of my said Grand-children the children of my said son James shall respectively attain the age of Twenty-one years, I direct my said Executor and Trustee to pay over to such child so attaining that age an equal share or portion of such Trust Estate. The share so to be paid over to be such as that each child of my said son James shall receive an equal and like amount when each shall severally attain the age of Twenty-one years. In witness whereof, I Caroline M. Punderson the Testatrix have hereunto subscribed my name and affixed my seal this second day of October in the year one thousand eight hundred and sixty. C. M. Punderson in the presence of each of us, who have subscribed our names as attesting witnesses hereto, at the request of the said Testatrix who at this time of making such subscription and acknowledgement did declare this instrument so subscribed to be her Last Will and Testament Stephen L. Magoun of Hudson N.Y. Edmund Holley of Hudson N.Y. Surrogate Court, Columbia County In the matter of Proving the Last Will and Testament of Caroline M. Punderson dec.d Columbia County SS: Stephen L. Magoun and Edmund Holley each of the City of Hudson in the County of Columbia being first duly sworn in open Court, in their oaths do depose and say that they are subscribing witnesses [page 639] to the Instrument now shown to them purporting to be the Last Will and Testament of Caroline M. Punderson late of the City of Hudson, in the County of Columbia aforesaid deceased, and bearing date on the Second of October in the year of Our Lord one thousand eight hundred and sixty. That the deponents signed their names as witnesses to said instrument at the request and in the presence of each the said Caroline M. Punderson and in the presence of each other. That the deponents saw the said Caroline M. Punderson execute the said Instrument and heard her declare the same to be her last Will and Testament at which time the said Caroline M. Punderson was upwards of twenty-one years of age, of sound mind and memory, not under restraint to the knowledge or belief of these deponents. That the said Caroline M. Punderson is now dead, and was at the time of her death an inhabitant of the City of Hudson in the County of Columbia and State of New York.
