Recorded April 26, 1878 I, Morton Mowry Aldrich of Chatham Village, Town of Ghent, Columbia County in State of New York, do make this my last Will and Testament in manner following, that is to say. First. I direct that all my just debts, funeral expenses and the expenses of settling my estate be paid out of my estate. Second. I direct and my will is that after my decease my body shall be entombed in the receiving tomb at Greeneville in the Town of Smithfield in the State of Rhode island there to remain for a reasonable length of time then to be removed and buried in the Burial Ground of George Wm. Burroughs in said Smithfield. And further it is my will that at the time of my burial, or as soon thereafter as may be suitable gravestones shall be erected over my grave and also over the grave of my daughter Waity; Third. I give, devise and bequeath to my wife Emily Aldrich all my estate both Real and Personal, and wheresoever the same may be situate and lying, for and during her natural life, providing she remains my widow, and after her decease, or at such time as she shall marry again, the same to be divided equally between my two sons, William Henry Aldrich and Otis Paine Aldrich, share and share alike, the same to be and to remain to them, their heirs and assigns forever. Fourth. I do hereby nominate and appoint my said son William Henry Aldrich, sole executor of this my last will and testament, and do hereby make and annul all other and former wills by me made, and publish and established this and this only as my last will and testament. In witness whereof I have hereunto set my hand at said Smithfield on this twelfth day of September in the year of our Lord one thousand eight hundred and seventy seven. Tobey on Tuesday the Thirteenth day of November A. D. 1877, present Pardon Angell, president, Ethan C. Thornton, Daniel S. Collins, Joseph A. Estes, members of said court. The petition in writing of William H. Aldrich of the city, county and State of New York praying that a certain instrument in writing presented therewith purporting to be the last will and testament of Morton Mowry Aldrich, late a resident of said Smithfield, deceased, may be proved, allowed and recorded, and that letters testamentary on the estate of said Morton Mowry Aldrich may be granted to him, is presented to this court, accompanying which is a writing signed by William H. Aldrich, Otis P. Aldrich and Emily Aldrich in which they assent to this Court's proceeding on said petition at this time and place; and it appearing that said William H. Aldrich, Otis P. Aldrich and Emily aldrich are all the persons interested in said petition, said petition is taken up for consideration; and said instrument in writing is now read, and the three subscribing witnesses thereto, to wit: George M. Appleby, J. C. Budlong and John Angell present, sworn and examined and it appearing that said instrument is the last will and testament of said deceased was legally executed and that said testator was at the time of making the same of sane mind and over twenty one years of age; and no person appearing to object thereto, said instrument is thereupon adjudged to be proved and the same is approved, accepted and allowed as and for the last will and testament of said Morton Mowry Aldrich, deceased, and it is ordered as such the same be recorded and that letters testamentary on the estate of said Morton Mowry Aldrich be granted to said William H. Aldrich is ordered and required before entering upon said trust to give bond in the sum of thirty-five hundred dollars, with George L. Burroughs and William Winser, both of said Smithfield, as sureties in the form prescribed by law. And George M. Appleby, Albert J. Mowry and Gilbert Mowry are appointed appraisers of the goods, chattels, rights and grants, which were of said Morton Mowry Aldrich. Witnesses: Oscar A. Tabey, Probate clerk Letter Testamentary The State of Rhode Island and Providence Plantations Providence ss: By the Court of Probate of the Town of Smithfield, in the County of Providence and State aforesaid. To William H. Aldrich of the City, County and State of New York, greeting. Whereas this Court have this day proved, approved, allowed and caused to be recorded the last will and testament of Morton Mowry Aldrich, late of Smtihfield in said County, deceased, which is hereunto annexed, wherein you are named as the Executor thereof, and you, having accepted said trust and given bond as the law tirects, are by these presents authorized and empowered to recover, receive and take possession of the estate whereof said Morton M. Aldrich died siezed and possessed, and the same to administer according to law, and the provisions of said last will and testament.
