Recorded August 9 AD 1876. I, Archelaus Brandt of the Town of Ancram, County of Columbia and State of New York, being of sound mind and memory, do make and publish and declare this my Last Will and testament in manner following, that is to say; First. I do hereby nominate and appoint my wife M. Marilla Brandt Executrix and my son Ellsworth J Brandt Executor of this my Last Will and testament, thereby revoking all former Wills by me made, and hereby order the above named Executors to pay all of my just debts and funeral expenses. Second. I give and bequeath unto my son Ellsworth J Brandt and my daughter Agnes A. wife of John S Williams, all of my personal property consisting of money, notes, bonds and mortgages, after paying my just debts and funeral expenses as ordered in Article first, share and share alike. Third. I give, devise and bequeath to my son Ellsworth J Brandt all of my interest in the Ancram Cemetery absolutely. Fourth. I give, devise and bequeath to my wife M. Marilla Brandt the use and occupation of my Homestead farm, Household furniture, stock and farming implements that's on said farm at the time of my decease, for the sole use income and profit hereof for and during her natural life. Providing however that in case my said wife should marry again after my decease and not remain my widow, then and in that case my will is, and I give, devise and bequeath unto my said wife the one equal one third of all my personal property. Whatsoever the Law maybe, and such interests to my real estate as the law shall direct, where of ____ to be accepted by her. After the decease of my said wife, in case she remains my widow until her death, then and in that case, my Will is that all of my Real and Personal property that shall remain be equally divided between my two children, I have and share alike therein. In witness whereof I have herewith set my hand and seal this the 21st day of October 1873. Archelaus Brandt (LS) The above instrument containing one sheet of paper, was at the date thereof declared to us by Archelaus Brant the testator therein mentioned to be his Last Will and testament and he at the same time acknowledged to us and each of us, that he had signed and sealed the same, and we thereupon at his request and in his presence and in the presence of each other signed our names thereto as such attesting witnesses. A N Daniels, Ancram Col Co. NY J D Neir, Ancram Col Co. NY Surrogate Court, Columbia County in the matter of proving the Last Will and Testament of Archelaus Brandt deceased Columbia County ss: Elisha Moore of the Town of Ancram of said County being duly sworn as a witness in the above enlisted matter on behalf of the Petitioner to prove said Will says. That he was well acquainted with James D Neir late of said town of Ancram deceased, and with his manner and style of handwriting having often seen him write, and that he verily believes that the signature "J.D. Neir" subscribed as a witness to the instrument in writing now produced and shown deponent, purporting to be the Last will and Testament of Archelaus Brandt deceased bearing date Oct 21 1873, is the proper signature and handwriting of said James D Neir. That said James D Neir died in June 1846. Deponent further says that he was well acquainted with said Archelaus Brandt in his lifetime, and with his manner and style of handwriting, having often seen him write, and that he verily believes that the signature "Archelaus Brandt" signed at the end of said instrument is the true and genuine signature and handwriting of said Brandt. Elisha Moore Sworn to before me in open Court this 9th day of August 1876 H.V. Esselstyn Surrogate Columbia County ss: Alauson N Daniels of the Town of Ancram in the said County, being first duly sworn deposes and says that he is a subscribing witness to the instrument now shown to him, purporting to be the last Will and testament of Archelaus Brandt deceased, and bearing date on this 21st day of October, in the year of our Lord 1873; that the deponent and James D Neir the other subscribing witness, signed their names as witnesses to said instrument, at the request and in the presence of the said Archelaus Brandt, and in the presence of each other; that the deponent saw the said Brandt execute the said instrument, and heard him declare the same to be his last will and testament, at which time the said Brandt was of sound mind and memory, of full age, and not under restraint according to the deponents best knowledge and belief; that the said Archelaus Brandt is now dead, was a citizen of the United States, and was at the time of his death an inhabitant of the Town of Ancram in the County of Columbia and State of New York. Esselstyn Surrogate Columbia County ss: Recorded the preceding Last Will and testament of Archelaus Brandt late of Columbia County deceased, as a Will of real and personal Estate, with the proofs relating to said Will taken in the Court of the Surrogate of said County, which record is hereby signed and certified by me pursuant to the provisions of the Revised Statues of the State of New York this 9th day of August AD 1876.
