Record of the last will and testament of Peter Smith, late of the City of Hudson, Columbia County, NY, deceased, as a will valid to pass real and personal property, and the decree admitting such will to probate. Recorded December 28, 1894. The last will and testament of Peter Smith of the city of Hudson, in the County of Columbia in the State of New York. I Peter Smith, knowing the uncertainty of human life and being of sound and disposing mind, memory and understanding do hereby make, publish and declare my last will and testament in manner and form following, that is to say First . . . I order and direct that all my just debts and funeral expenses be paid as soon as conveniently may be after my decease. Second . . . I give and bequeath unto my daughter Emma J. Day, wife of James Henry Day, the sum of three hundred and fifty dollars. Third . . . all the rest, residue and remainder of my estate, both real and personal and of whatsoever name and nature and wheresoever situated. I give and bequeath unto my beloved wife Annie Smith to have and to hold to her, her heirs, executors, administrators and assigns forever. Witness H. Lyle Smith, M.D. William Van Bach Lastly I make, constitute and appoint my friend Henry Kertz of the City of Hudson aforesaid to be executor of this my last will and testament, hereby revoking all former wills by me made. In Witness Whereof. I have hereunto subscribed my name and affixed my seal the seventh day of August in the year of our Lord one thousand eight hundred and ninety-four. Isaac Collier, Surrogate, found as matters of fact that Peter Smith died on or about 7 September 1894, at age 68 or 69, that he was married twice, that Emma J. Day was a child by his first marriage, that he married the second wife Annie in January 1883, and he died without issue from the second marriage.
