Recorded January 17th, 1902 I, COLUMBUS BRANDT, of Ancram, Columbia County, New York make this as my Last Will and Testament; I give to my wife Sylvia Brandt all my property and estate. I hereby appoint my said wife sole executrix of this my Last Will and Testament. IN WITNESS WHEREOF I have hereunto set my hand this nineteen day of January one thousand eight hundred and eighty two. COLUMBUS BRANDT The above instrument was subscribed by the Testator Columbus Brandt in our presence and was at the same time declared by him to be his last will and Testament and we at his request in his presence and in the presence of each other have signed our names hereto as witnesses. Frank Eno, Pine Plans, Dutchess Co., N.Y. James P. Morgan, Pine Plains, Dutchess Co., N.Y. In the Matter of Proving the Last Will and Testament ---of--- COLUMBUS BRANDT, Deceased. COLUMBIA COUNTY, SS: Frank Eno of the Town of Pine Plains, Dutchess Co., and James P. Morgan of the town of Pine Plains, in the County of Dutchess being first duly sworn in open Court, on their oaths do depose and say that they are subscribing witnesses to the instrument now show to them purporting to be the Last Will and Testament of Columbus Brandt late of the Town of Ancram, in the County of Columbia aforesaid deceased, and bearing date on the 19th day of January in the year of our Lord one thousand eight hundred and eight two. That the deponents signed their names as witnesses to said instrument at the request and in the presence of the said Columbus Brandt and in the presence of each other. That the deponents saw the said Columbus Brandt execute the said instrument and heard him declare the same to be his Last Will and Testament at which time the said Columbus Brandt was upwards of twenty one years of age and of sound mind and memory, and not under restraint to the knowledge and belief of these deponents. That the said Columbus Brandt is now dead and was at the time of his death an inhabitant of the Town of Ancram, in the County of Columbia and State of New York. Frank Eno James P. Whitbeck, Surrogate At a Surrogate's Court held in and for the County of Columbia at the Surrogate's Office in the City of Hudson, on the 17th day of January, 1902. PRESENT - THE SURROGATE. In the Matter of the Last Will and Testament --of-- COLUMBUS BRANDT, Deceased. On the application of Sylvia Brandt residing at Ancram, N.Y., widow of deceased and sole executrix named in said will and on filing due proof of service of citation herein or a waiver thereof on all the heirs at law and next of kin of said deceased, all being of full age, and after hearing the proofs and it appearing that said will was duly executed; that the testator was at the time of making said will in all respects competent to make the same and was not under any restraint, IT IS ORDERED AND DECREED, That said will bearing date January 19th, 1882 be and the same hereby is admitted to Probate as a will valid to pass real and personal property and that the same with the proofs relating thereto be recorded accordingly, the probate of said will not having been contested. ORDERED FURTHER, That Letters Testamentary thereof issue to said Sylvia Brandt, she having taken and filed the oath prescribed by law. John V. Whitbeck, Surrogate.
