In the name of God Amen, I Timothy Howland of the town of Hyde Park and County of Dutchess being of sound mind memory age & understanding, blessed be God for the same do make and publish this my last Will and Testamentin manner and form following that is to say First – I do order and direct that all my just debts and funeral charges be first paid out of my personal Estate except such a part as shall be herein after disposed of and in case of a deficiency of assets for that that purpose I hereby authorize and empower my Executors hereinafter named to sell all or so much of my real estate as may be sufficient to make up the deficiency, of legal assets and to make and execute a deed or deeds for the same and generally to do and perform all acts necessary to affectuate my intentions. Secondly – I order my said Executors hereinafter named to sell and dispose of all of my Real Estate as soon after my decease as they shall think proper for the benefit of my said children herein-after named. Thirdly – I hereby give devise and bequeath unto my five sons Joseph M., Solomon, Henry, Timothy and William the sum of five hundred dollars to each and every one of them respectively to them and their lines forever and that my son Joseph M. has been paid the sum of five hundred dollars, which is in lieu of the above named legacy. Fourthly – I hereby give devise and bequeath unto my six daughters Deally, Cornealy, Cyntha, Mariah, Caroline and Julian the sum of three hundred and sixty-six dollars to each and every one of them to them and their heirs forever and to my daughter Deally has been paid three hundred and sixty-six dollars which is In lieu of the above named legacy and that my daughter Cornelia has been paid three hundred and sixty-six dollars which hah been paid in lieu of the above legacy and that my daughter Cyntha has been paid three hundred and sixty-six dollars in lieu of the above legacy also that the above named legacys which have not been paid shall be paid to my said children respectively at the lawful age of twenty-one years if my property be sold by my executors. Fifthly – I hereby give and bequeath unto my said daughters above named all my household furniture to be equally divided share and share alike. Sixthly – I hereby order that after paying all my just debts and the above named legacys that the residue and remainder of my estate shall be equally divided with all my above named children share and share alike to them and their heirs forever. Also I hereby appoint Stephen Briggs, Henry Frost and my son Joseph M. Howland my Executors and I also appoint these my executors as guardians of my minor children respectively declaring that this be my last Will and Testament hereby revoking all former Wills by me at any time heretofore made in witness whereof I have hereunto set my hand and seal this thirtyeth day of twelfth month in the year of our Lord one thousand Eight hundred and twenty-nine. Timothy Howland SS Signed in the presence of us as witnesses Nathaniel Arnold, Nehemiah Hoag and Elias Alley Whereas I Timothy Howland of the Town of Hyde Park and Dutches County have made my last Will and Testament in writing bearing date the thirteenth of twelfth month one thousand Eight hundred twenty nine. Now I do by this my writing which I hereby declare to be a codicil to my said Will to be taken as part thereof direct that three hundred dollars and sixty-six dollars named in the above Will has been paid unto my daughter Caroline as part of her dower and lastly it is my desire that this my present codicil be made part of my last Will and Testament to all intents and purposes in witness whreof I have set my hand and seal the sixteenth of fifth month one thousand Eight hundred and thirty-three. Timothy Howland SS Signed sealed and declared to be a codicil annexed to his said last Will and Testament in the presence of Daniel Briggs and Henry Briggs Will and codicil proved 25 November 1833 in Dutchess County Surrogate Court Additional Comments: This will is very light and difficult to read, but it is clear that it was executed the "thirtyeth" day; the codicil appears to say the will was executed the "thirteenth" day, but it could be the "thirteeyth" day.
