Will of Henry Diel deceased Probate dated 11 May 1772 Recorded Dutchess,
Rhinebeck Precinct AD-84 Albany Co., NY

In the name of God Amen

The Thirteenth Day of June, in the year of our Lord God One Thousand Seven
Hundred and seventy One I Henry Teel of Rhinebeck Prect in the County of
Dutchess and province of New York in North America Yeoman being sick and weak
in body but of perfect mind and memory, thanks be given unto God. Therefore
calling into mind the mortality of my body and that it is appointed for all
men once to die, do make and ordain this my Last Will and Testament. That is
to say, Principally and first of all I recommend my soul into the hand of
Almighty God that gave it, and my body I recommend to the Earth, to be buried
in a decent Christian Burial at the discretion of my Executors, nothing
doubting but at the general Resurrection I shall receive the same again by the
mighty Power of God, and as touching such worldly estate wherewith it has
pleased God to bless me in this Life, I give, demise and dispose of the Same
in the following manner and Form.

First I will and order that all my Debts and funeral expenses be paid in due
time

To my eldest son Johannes I give Twenty Shillings New York Lawfully Currency
for his Primogeniture wherewith he is to rest Satisfy'd and I will that he
shall make no further and other Pretense for being my oldest Son and Heir at
Law.

Item. To my Two Sons Carl and Jacob and to their Heirs & Assigns forever I
give those Two Pieces of Land, Viz which I have a Lease of Col. Hen. Beekman
and the other which I Bought of Jacob Lewis with all the Buildings on the
Same, and with all the Appurtenances to the Said Lands and Premises, belonging
or in any Wise appertaining as also the Winter & Summer Crops on Said Land and
Premises now growing. For which each of my aforesaid Two Sons Carl and Jacob,
or their heirs Executors and Administrators, Sha;; Pay Two Hundred pounds New
York Lawfull Currency within the first ten years after my decease, that is to
say each Twenty Pounds of aforesaid Lawful Money yearly, so that the Last
payment of aforesaid two hundred pounds shall be made by each of my aforesaid
sons Carl and Jacob, their Heirs, Executors and Administrators before the
expiration of the Tenth year next after my decease. And I will and order that
the aforesaid Four Hundred Pounds New York Currency Shall be equally share and
share alike divided between my other ten children, Viz Elizabeth, Johannes,
Anna, Catherine, Anna Mary, Henry, Zacharias, William, Lawrentz, Cornelius or
their Heirs each Forth Pounds.

Item. All my personal estate, goods and chattels whatsoever and wheresoever
Viz. Bonds, Notes, Book Debts, and other Debts, Due and owing unto me, my
Household goods, all my creatures of what kind soever Hoof and Horn Beast
Sheep &c. all my Farming Utensils in Short all my moveables, I will and order
that they shall be divided equally Bea Share and Share alike among all my
aforesaid Twelve Children.

Item. I will and order that in Case one of my said children or more should
happen to die before the attainment of twenty one years or without being
married before that age that the that share of such of my child or children so
dying as aforesaid shall be equally divided among all my surviving children.

Item. I do hereby make, constitute and ordain my good friends Helmus Feller,
Fredrick Neher and Cornelius Miller, Executors of this my Last Will and
Testament, not in the least doubting but what they will see the same performed
according to my true intent and meaning. And I do hereby utterly disallow
revoke and disannull all and every other former Testaments and Wills &c
Ratifying and confirming this and no other to be my last will and testament.

Signed, sealed, published and declared by the Said testator as for his Last
Will and Testament in the presence of us, who at his request, in his presence,
and in the presence of each other have subscribed our names as witnesses
thereto

Dutchess County Be it remembered that on the twentieth day of February One
Thousand Seven Hundred & seventy Two personally came and appeared before me
Anthony Hoffman Surrogate of said County, Jeury Adam Zufelt of Rhinebeck
precinct in said county, Farmer and being duly sworn on his oath declared that
he did see Henry Diel sign & seal the annexed instrument purported to be the
will of the said Henry Diel bearing date the thirteenth day of June one
thousand seven hundred and seventy one. __ heard him publish and declare the
same as and for his last will and testament. That at the time thereof he the
said Henry Diel was of sound disposing mind and memory to the best of the
knowledge and belief of this deponent and that his name subscribed to the said
will is of his own proper hand writing which he subscribed as a witness to the
said will in the presence of the testator. And that he the deponent sa__ John
Schultz and Christian Schultz the other witnesses to this will subscribe their
names as witnesses thereto in the testator's presence.

Dutchess County Be it also remembered that on the twenty second day of
February in the year aforesaid Helmus Feller, Frederick Neher and Cornelius
Miller the executors of the annexed written will of Henry Diel likewise
appeared before me the said Anthony Hoffman and were duly sworn to the True
Execution and performance of the said will by severally taking the path of an
executor, as by law appointed; before me
