Will Book Vol. 17 page 237 Written: March 23, 1750 Recorded: October 17, 1750 In the name of God Amen, Be it known unto all men by these Presents that on this 23 of March anno domini 1750, I the subscriber Hendricus Heermanse, Living in Rhynbeck Precinct in Dutchess County in the province of New York In America, Being at presents Sick & Indisposed in Body but Having the Perfect use of my Knowledge & Senses the Lord be praised for his Mercys, And Considering the Shortness, frailty & fragility of Man's life, the Certainty of Death, & uncertain ______ thereof, am therefore Desirous to Settle all matters, And for that purpose do make this my last Will & Testament in manner & form following: Revoking, Annulling & making void by these presents all former will or wills, Testament or Testaments heretofore by me Executed or made, & that this alone shall be esteemed my last Will & Testament & none else besides,& in the first place recommending my Immortal Soul when it shall depart out of this my Mortal body into the Hands of the Living God Hoping & only Trusting to be Sav'd & made happy through the all sufficient merits of my redeemer & only Savior Jesus Christ, And my body to the Earth from Whence it came and to be inter'd in a Christianlike manner In hopes of a Glorious Resurrection at the last day, And concerning Such temporal Estate, as Lands, Houses, Slaves, Horses, Cattle, Debts, Gold & Silver Coind or Not Coind, wherewith the Lord hath been pleas'd to bless me far above my deserts, I ordain, give & dispose of the Same as follows---- Item It is my will & desire that all my Just debts be discharged in due Time. Item I give to my dear & Loving wife Antje, During her Widowhood for her use, the one half of my farm of Land whereon I at present are dwelling, with the House, Barn & Homestead, So as at this time I occupy or use it, with all my moveable or loose Estate, belonging unto me, But incaise she should find any part of my Personal Estate of which she did not stand in absolute need of, Then she is to divide the same amongst my Heirs hereafter to be mentioned, to be equally divided, also all my moveable or Personal Estate Shalls be Equally Divided amongst my Heirs after the decease of my Said Wife, In manner Hereafter divided-- 2ndly It is my will & desire that my Son Hendricus Heermanse Shall Have & Enjoy, as by these Presents I grant unto him his order or Heirs, (a) signifies all Heirs and assigns, forever all that wholepiece of Land or farm whereon we now at Present are both Residing with all that depends Thereon, So as my father in Law Gerrit Aarsen (note--Aertson in Dutch version) has made the same over to me, On Condition that it Shall be accounted to him Out of my Estate for the Sum of Two Hundred & Sixty Five pounds current money of New York, which I order to be Equally divided among my Heirs to be named hereafter, But on condition that my Said Wife shall wholy Possess & use one Half of this Land during her Widowhood as mention'd above, 3rdly It is my will & desire that my Son Philippus Heermanse Shall have & Enjoy; as by these Present I grant to him his order or Heirs forever Two Hundred & Six Acres of Land where he at Present lives on the South East Side of Wappings Kill, & Shall run from the Hill South Easterly between a Lott of Theunis Van Benschoten and a Lott of my Brother Andries Heermanse so far as to Comprehend Two Hundred & Six acres, also yet Sixty-nine acres of Woodland, lying in the Southwest corner o my Tract next to a Lott of Brother Andries Heermanse, On Condition that the said Two Parcels Shall be reckoned to him of my Estate for the Sum of Ohe Hundred & Fifty Pounds Current money of New York to be divided as above is Said, 4thly It is my Will & Desire that my son Wilhelmus Heermanse shall have & Enjoy, as by these Presents I grant to him his order or Heirs forever Two Hundred fifty Seven acres of Land next to the Land abovegiven to my Son Philippus beginning at the South East Corner of my Tract next to the Lott of Theunis Van Bunschote & shall run along his line to the Said Lott of my Son Philippus & then along him as far Westerly as his Lott go's, then South 30* East, so far till it comes with a direct line upon the North Corner of my Son Philip' woodlott, The Lott contains Two Hundred Seventy five acres, On Condition that the said piece of Ground Shall be accounted to him of my Estate for the sum of One Hundred & Seventeen pounds Current mony of New York to be divided as above said, 5thly It is my Will & desire that my Son Andries Heermanse Jun Shall have & Enjoy, As I grant by these Presents to him his order or Heirs forever, Two Hundred and Seventy five (note Sevontigh in Dutch version) acres of Land the overplus of my said Tract & is bounded on the Southside of a lot of brother Andries, Being the middle lot, on condition that it Shall be accounted to him, out of my Estate or the Sum of Sixty Seven Pounds currents money of New York to be divided as aforesaid 6thly I do Appoint to be my Heires my Six Children namely Hendricus, Philippus, Wilhelmus, Andries, Margriet, wife of Jacobus Oostrander, & Jannetje, wife of Cornelis Oostrander; and I do will and desire that the Six Hundred Pounds, which my sons as aforesaid are to account for the Lands, with alls the rest of my Estate of what nature or Kind the same may be, which is not already above devised, Shalts be Equally divided among my Said Six Children, Share & Share alike, Each of them their order or Heirs Shall have an Equal Sixtparte; But in as much as my Son in Law, Jacobus Oostrander Husband of daughter Grietje, Is in my opinion Heedless & given to Drunkenness, which possibly may reduce them to want (which God forbid) I have therefore thout proper, to Have the portion or Share of my said daughter Margaret put out at Interest for the use of Her, & I hereby grant fulls power & Authority to my Executors Hereafter named, so to do, during her life, And the rents yearly to be given to her and after her decease, to be paid to her children respectively as they become of age, Each their Equal Share or proportion 7thly It is my will & desire that the moneys which is to be allow'd by my Sons for the lands abovesaid Shall by them be paid within Eight Years after my deceased, and that the Said moneys shalt be then divided as abovesaid, what relates to the rest of my Personal or moveable Estate that shall be divided after the decease of my said wife as abovesaid 8thly I do appoint to be Executors of this my Last Will & Testament my four sons aforesaid, Hendricus, Philippus, Wilhelmus, and Andries & the survivor of them, requesting and desiring of them That all whats abovementiond shalt be punctually observ'd & performd, Thus done at my House the day and Year aforesaid Signed Hendrikis Heermans LS Sign'd Seald & published by this, abovenamed Hendricus Heermanse as his last Will & Testament in presense of uv. as witnesses.
