The first day of December in the year of our Lord one thousand seven hundred and forty four, I, Jacobus Swartwout of the Fishkill and County of Dutchess, Gentleman, being in perfect health and strength, Thanks be given unto God therefor. Calling into mind the mortality of my body, and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament, that is to say, Principally and first of all, I give and recommend my soul into the hands of God that gave it, and for my body I recommend it to the earth, to be buried in a Christian like and decent manner, at the discretion of my executors, nothing doubting but at the General Resurrection, I shall receive the same again by the mighty power of God, and as touching such wordly estate where with it hath please God to bless me in this life, I give devise and dispose of the same in the following manner and form. I give and bequeath to my well beloved wife as long as she remains my widow the use of all my real estate, but in case my wife should remarry should have only the income off half my lands and one negro wench and one bed and furniture. I give to my son Thomas sixty pounds or the choice of one of my negroes for his birth rite, further I give to my sons Thomas, Cornelius, Adolphus, Samuell, and Jacobus, their heirs and assigns, all my real estate equally amongst them, but in case any should dye before they come to age or have a child, the surviving brothers to divide that share equally them, I give to my daughters Jacomintie and Katherine twenty five pounds each, and then my movable estate (which is not bequethed) to be equally divided between my daughters Elizabeth, Janetie, Jacomintie, and Katherine, after my lawful debts and funeral charges are paid,
