I William Gay of Charlotte Precinct in Dutchess County in the province of New York, blacksmith, being very sick and weak in body but of sound and disposing mind, memory and understanding do make and publish this my last will and testament in manner and form following. First and principally, I recommend my soul into the hands of almighty God that gave it, and my body to the earth to be buried in a Christian like and decent manner at the discretion of my executrix and executors herein after named, nothing doubting of a glorious resurrection through the merits of my dear redeemer, Jesus Christ, and as for such worldly estate wherewith it hath pleased God to bless me with I give devise and dispose of the same in manner and form following. Item---my will is and I do order that my just debts and funeral charges shall be paid and satisfied by my executors out of my estate within some convenient time after my decease. Item. I will and order my executors (herein after mentioned) to sell off and dispose of my land near the forks of the fall kill and out of them monies to pay my debts and if they do not satisfy them then to sell so much of my moveable estate is to satisfy my debts. Item. I give and bequeath all y estate both real and personal whatsoever and wheresoever unto my bellowed wife Mary gay for and during and so long as she shall remain my widow and to receive and take to her own use and behalf the rents issues and profits thereof from and immediately after my decease for and during the said term of want. Item. After my said wife's death or marriage which shall first happen I give devise and bequeath unto my two sons John Gay and Abraham Gay all and singular of blacksmith tools of what kind so ever as also a rifle gun to my son John and one common small gun to my son Abraham. Item after my said wife's marriage or death I give devise and bequeath unto my seven children (to wit) Elizabeth, Johanna, Helena, Margaret, Jane, John and Abraham and to their several heirs and assigns forever each an equal seventh part or share of all my estate both real and personal of what kind so ever share and share alike. To hold to them also as tenants in common and in case many of my said children should happen to die without lawful issue or last will or testament such share or share I will and order to be equally divided among the survivors each share and share alike. Item. My will is that before any division be made of my estate either real or personal that my guns as also all and singular of my blacksmith tools shall be given to my two sons and I hereby nominate and appoint my beloved wife Mary executrix and my trusty friends Leonard Van Kleck and Hendrick Hageman executors of this my last will and testament hereby revoking all former will and wills by me heretofore made in witness whereof I, the said William Gay, have to this my last will and testament wrote on a sheet of common paper set my hand and suffixed my seal this twenty eighth day of July on the ninth year of our reign and in the year of our Lord one thousand seven hundred and sixty nine, William Gay (S.S) signed sealed published pronounced and sealed by the within named William Gay and for his last will and testament in the presence of us who have hereunto subscribed our names as witnesses thereto in the presence of the said Testator and in the presence of each other. Be it remembered that on the sixth day of November in the year of our Lord one thousand seven hundred and eighty eight personally came and appeared before me Gilbert Livingston, Surrogate of the said county, Lewis Clarwater of Dutchess County farmer and being duly sworn on his oath declared that he did see William Gay bearing date of the twenty eighth day of July in the year of our Lord one thousand seven hundred and sixty nine and heard him publish and declare he same as and for his last will and testament that at the time thereof he the said William Gay was of sound disposing mind and memory to the best of the knowledge and believe of him the deponent and that Gale Yelverton, Jacob Concklin and the deponent, by making his mark, severally subscribed the said will as witness thereto in the testators presence Gilbert Livingston Surrogate (S.S.) The People of the State of New York by the grace of God free and independent to all to whom these presents shall come or may concern said greeting. Know ye that at Poughkeepsie in Dutchess County and State aforesaid on the sixth day of November one thousand seven hundred and eighty-eight before Gilbert Livingston Esquire Surrogate of our said county the last will and testament of William Gay deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this State by means whereof the proving and registering the said will and the granting administrations of all and singular the said goods, chattels and credits, and also the auditing, allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods, chattels and credits of the said deceased and any way concerning his will is granted unto Mary Gay the executrix, in the said will named she being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the Seal of Office of our said Surrogate to be thereunto affixed, witness Gilbert Livingston Esquire surrogate of the said County at Poughkeepsie the seventh day of November in the year of our Lord one thousand seven hundred and eighty-eight and of our independence the thirteenth.
