I Moses Barlow of the town of Amenia county of Dutchess and state of New York being weak in body but of sound mind and memory, blessed be god, do this twelfth day of January the year of our Lord one thousand seven hundred and ninety six, make and publish this my last will and testament in manner [and] form following, that is to say: Imprimis I commend my soul into the hands of almighty god who gave it me; and my body to the earth from whence it came, in hopes of a joyful resurrection through the merit of my saviour Jesus Christ and as for that worldly estate wherewith it has pleased god to bless me I dispose thereof as follows: First, I give to my wife Sarah Barlow the dwelling hous wherein I now live, with the garden and the dooryard during her natural life. Item I give and devise all my lands lying in the town of kent county of lithfield and State of Connecticut to my son Thomas Barlow his heirs and assigns for ever. Item I give and devise all my other lands and tenements whatsoever to my son Elisha Barlow, my son Thomas Barlow, their heirs and assigns for ever. Item I give and bequeath ---- to my daughter Silvina the sum of one hundred pounds. Item I give and bequeath to my daughter Mehetable seventy pounds. Item I give one hundred pounds to my daughter Jemima, all three of said legacies to my said daughters to be paid one half of the said several sums to be paid at the end of one year and the other half of said sums at the end of two years after my decease. Item I give to my daughter Elizabeth the sum of one hundred pounds to be paid to her if she survives her present husband Lott Swift or is otherwise lawfully discharged from him. It is my will that the lawful Interest of the said sum of one hundred pounds is to be paid to my said daughter Elizabeth annually the interest to commence in six months after my decease and if my said daughter Elizabeth should not survive her present husband Lott Swift nor be otherwise lawfully discharged from him, then from and after her decease I give and devise the same to her daughters to be equally divided between them and in default of such female issue then to the heirs male of her body begotten and in default of such issue to remain to my right heirs forever. Item all the rest and residue of my goods chattels and personal whatsoever I give to my two said sons Elisha Barlow and Thomas Barlow. Item I give to my daughter Elizabeth if she should live separate from her present husband Lott Swift the use of one room in the house where I now live for the time she shall remain in a single state she making no spoil, wast or destruction thereupon. And I make, constitute and ordain my two sons Elisha Barlow and Thomas Barlow my executors of this my will to take care and see the same perform according to my true intent and meaning. Item it is my will that my daughter Elizabeth should have the use of one of the bedrooms in the house where I now live if she should lawfully be separated from her present husband Lott Swift before his death and during her living in a single state this bedroom is to be used in addition to the first mentioned room bequeathed for her use. Item it is my will that my son Elisha Barlow shall have the house , store and Barn that he now occupies and the easternmost barn that I myself now occupy. Item it is my will that my son Thomas Barlow shall have the dwelling house that he now lives in and the westernmost barn and barrack that I now occupy in witness whereof I the said Moses Barlow have to this my last will and testament set my hand and seal the day and year above written. Moses Barlow LS signed sealed published and declared by the said Moses Barlow as and for his last will and testament in the presence of us whose names are hereunder written who did each of us subscribe our names as witnesses at his request and in his presence in the room where he then was. Erastus Chamberlin, Amos Hainket, Ephraim Chamberlain N.B. in witness in the [?] eighth line was obliterated before signing and sealing hereof us [?] interlineations as Swift said her.__ I Moses Barlow being of sound mind and memory do alter this my within will so far as it respects the legacy given to my daughter Elizabeth descending her daughters viz. It is my will that if the said legacy of one hundred pounds given to my said daughter Elizabeth should default on her children that it should be equally divided amongst the children of her body begotten as well sons as daughters and as well it is that my wife Sarah should have all my household furniture that I may die posessed of in witness of the above alterations to this my within last will and testament I have hereunto set my hand and seal this third day of May 1796 Moses Barlow LS Amos Hainket, Ephraim Chamberlain, Moses Witherell - I Moses Barlow continuing weak in body but of sound mind and body do give unto my daughter Elizabeth ten cords fire wood annually so long as she shall live in the house as she is entitled to in the former part of this my will and it is my will that my two sons Elisha and Thomas shall each of them cut and draw for her five cords of the said wood. It is also my will that she shall [? ] garding spot and adjoining the Southernmost of the door yard [missing line of writing here] .Elisha and Thomas shall pasture and winter a row for my said daughter Elizabeth as long as she may so live in the said house and also it is my will that after the decease of my wife Sarah all the household furniture she may die possessed of should be equally divided among my four daughters, Silvina, Mehetable, Elizabeth and Jemima. In witness of this addition to my last will and testament I have hereunto set my hand and se[al] on this 23rd day of Febry 1797. So be it remembered that on the first day of July one thousand seven hundred and ninety nine purposefully appeared before me Gilbert Livingston surrogate of the said county, Ephraim Chamberlain of Dutchess county farmer who on his honor declared that he did see Moses Barlow sign and seal the annexed written instrument purporting to be the will of the said Moses Barlow bearing date the twelfth day of January one thousand seven hundred and ninety six and heard him publish and declare the same as annexed for his last will and testament that the time thereof he the said Moses Barlow was of sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that Erastus Chamberlain and Amos Hainket with him the deponent severally subscribed the same will as witnesses thereto in the testators presence And the said Ephraim having farther sworn did on his oath declare that he did see Moses Barlow sign and seal the annexed written instrument purporting to be a will or a part of the will of the said Moses Barlow bearing date the third day of May one thousand seven hundred and ninety six and heard him publish and declare the same as and for some part of his last will and testament that at the time thereof he the said Moses Barlow was of sound disposing mind and memory to the best of the knowledge and belief him the deponent and that Amos Hainket, Moses Witherell and the deponent several subscribers Ephraim being farther sworn did on his oath declare that he [did] see the said Moses Barlow sign and seal the annexed written instrument purporting to be a codicil or further part of the will of the said Moses Barlow bearing date the twenty third day of February on thousand seven hundred and ninety seven and heard him publish and declare the same as and for a farther part of his last will and testament that at the time thereof he the said Moses Barlow was of sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that Erastus Chamberlain and the deponent severally subscribed the said codicil as with thereto in the testators presence Gilbert Livingston LS The people of the state of New york by the grace of god free and Independent to whom these presents shall come or may concern send greeting hear ye that at poughkeepsie in Dutchess county on the first of July on thousand seven hundred and ninety nine before Gilbert Livingston Esq surrogate of our said county the last will and testament of Moses Barlow deceased (a copy whereof is hereunto annexed and was proved and is now approved and allowed of by us and said deceased having whilst he lived and at the time of his death goods, chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of and singular the said goods, chattels and credits and also the proving, allowing and final discharging the amount thereof doth belong to us the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Elisha Barlow and Thomas Barlow the executors in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods, chattels and credits and also to enter a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto annexed.
