B page 250 Written: July 20 1798 Recorded: February 16 1801 In the Name of God Amen I Benjamin Delemater of the town of Amenia Dutchess County and State of New York being of sound mind and memory blessed be God therefor do this twentieth day of July in the year of our Lord one thousand seven hundred and ninety eight make and publish this my last will and testament in the maner following that is to say Imprimed I command my soul into the hand of Almighty God who gave it and my body to the earth to be burried in a christian and decent maner and as for that worldly estate wherewith it hath pleased God to bless me with after my funeral charges and debts are paid I dispose of in the following maner. First I give to my loving wife Hannah one third part of my moveable estate and the improvement of one third part of my real estate during her natural life. Item I give to my son Nicholas one sixth part of my Estate both real and personal. Item I give to my son Benjamin five sixth parts of my estate both real and personal after my debts and the legacies hereafter to be Named are Paid. Item I give to my daughter Susanah thirty pound to be paid to her when my youngest Child shall arrive at the full age of twenty one years. Item I give to my daughter Elizabeth sixty pound to be paid to her when she shall arrive to the full age of twenty one years or on her marriage day if she should marry before she arrives to the age of twenty one years. Item I give to my daughter Sarah sixty pound to be paid to her when she shall arrive at the full age of twenty one years or on her marriage day if she should marry before she should arrives at the age of twenty one years. Item I give to my daughter Polly sixty pound to be paid to her when she shall arrive at the full age of twenty one years or on her marriage day if she should marry before she arrives at the age of twenty one years. Item it is my will that my son Benjamin shall have the use and improvement of the Legacies given to my daughters Susanah Elizabeth Sarah and Polly until the usual times heretofore specified for the payment of the foregoing legacies of Susanah Elizabeth Sarah and Polly shall arrive he the said Benjamin giving sufficient security to my executors to pay the said Susanah Elizabeth Sarah and Polly their Legacies when they res___vily become due as it is heretofore provided and I make Constitute ordain and apoint my good trusty friends William Young and Amariah Winchester to be my executors of this my last will and testament and I hereby ratify and confirm that this is my last will and testament revoking and disannulling all my former wills and testaments. Whatsoever In witness whereof I the said Benjamin Delemater have to this my last will and testament set my hand and seal the day and year first above written. Benjamin Delemater Signed sealed Published and declared by the said Benjamin Delemater as and for his last will and testament in presence of us William Young, Samuel Row, Oliver Kellogg. Dutchess County. Be it remembered that on the eighth day of September one thousand and eight hundred personally appeared before me Gilbert Livingston surrogate of the said County William Young and Samuel Row of the town of Amenia in Dutchess County and Oliver Kellogg of the town of Sharon in the State of Connecticut who on their oaths declared that they did see Benjamin Delemater sign and seal the anexed written instrument purporting to be the Will of the said Benjamin Delemater bearing date the twentieth day of July one thousand seven hundred and ninety eight and heard him publish and declare the same as and for his last will and testament. That at the time thereof he the said Benjamin Delemater was of sound disposing mind and memory to the best of the knowledge and belief of them the deponents and that they severally subscribed the said will as witnesses thereto in the testors presence. Gilbert Livingston Dutchess County Recorded the preceeding will of Benjamin Delemater and the certificate of the proof thereof. "personally" wrote on ___ this sixteenth day of February 1801.
