The word estate interlined in the tenth line before the sealing or sining hear of, seald and signed in the presents of Ezekiel Herrick [[L.S.]] Standly Thompson, John Simmons, Henry Herrick, Dutchefs County Ls. be it remembered that on the twentieth day of April one thousand seven hundred and ninety six personally appeared before me Gilbert Livingston Surrogate of the said county. Stanly Thompson of Dutchefs county farmer who on his oath declared that he did see Ezekiel Herrick sign and seal the annexed written instrument purporting to be the will of the said Ezekiel Herrick bearing date the thirtieth day of January one Thousand seven hundred and ninety six and hear him publish and declare the fame as and for his last will and testament. That at the time thereof, he the said Ezekiel Herrick was of sound disposing mind and memory to the best of the knowledge of him the deponent and that John Simmon Henry Herrick and the deponent severally subscribed the said will and witnesses thereto in the testators presence. Gilbert Livingston [[L.S.]] The People of the state of New York by the Grace of God, free and Independent. To all to whom these presents shall come or may concern, send greeting. Know ye that at poghkeepsie in Dutchess County on the twentieth day of April one thousand seven hundred and ninety six before Gilbert Livingston Esq. surrogate of our said county, the last Will and testament of Ezekiel Herrick deceased ( a copy whereof is hereunto annexed) was proved, and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this state, by means whereof the proving registering the said Will and the grating administration of all and singular the said goods, chattels and credits, and also the auditing, allowing and final discharging the account thereof, doth belong unto us the administration of all and singular the Goods, Chattels of this said deceased, and any Way concerning his will is granted unto Nathaniel Powell one of the executors in the said will named he being first duly affirmed and the Reuben Wylie the other Executor in the said will named he being this [?] duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods, Chattels and Credits and also to render a just and true account thereof when thereunto required.
