B page 312 Last Will and testament of Josyah Herick of the town of Stanford Dutchess County and the Ste of New York being sound perfect in mind and memory do make and publish this my last will and testament in manner following that is to say first I will and order that all my just debts and funeral charges paid out of my estate secondly I give unto my wife my household furniture and the rest of my Estate I give equil amons all my children when they cum to lawfull age and tis my desire that they have sufficient school larning for common business and the money put out to interest in safe hands and I apoint my brother in law Abner Sarls and my brother in law Richard Simans and my cousin Reuben Wyles for my Executors to this my last will ans testament sined sealed in the presents of us this sixth day of the third month one thousen eight hundred and two Josiah Herrick [[LS]] Freelove Sarls her mark X Isaac Doty Dutchess County Ls. Be it remembered that on the eighth day of April one thousand eight hundred and two personally appeared before me Gilbert Livingston Surrogate of the said County Freelove Sarls wife of Abner Sarls of the town of Clinton in Dutchess County weaver who on oath declared that she did see Josiah Herrick sign and seal the anexed written instrument purporting to be the will of the said Josiah Herrick bearing date the sixth day of the third month one thousand eight hundred and two and heard him publish and dictate the same as and for his last will and testament that at the time thereof he the said Josiah Herrick was of sound disposing mind and memory to the best knowledge and belief of her the deponent and that Isaac Doty with her the deponent severally subscribed the said will as witnesses thereto in the testators presence Gilbert Livingston [[LS]] The People of the State of New York by the grace of God Free and Independent. To all whom these presents shall come or may concern, send greeting. Know ye that at Poughkeepsie in Dutchess County on the eighth day of April in the year of our Lord one thousand Eight hundred and two by Gilbert Livingston esquire Surrogate of our said county the last will and testament of Josiah Herrick deceased (a copy whereof is hereunto anexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death Goods, chattels or credits within this State by means whereof the proving and registering the said will and the granting administration of all and singular the said goods, chattels and credits and also the auditing allowing and final discharging the account thereof belong unto us the administration of all and singular the Goods, Chattel and credits of the said deceased in any way concerning his will is granted unto Richard N Seamen and Reuben Wiley the Executors in the said will named they being first duly sworn well and faithfully to administer the same and to make an exhibit a true and perfect inventory of all and singular the said goods, Chattels and Credits and also to render a just and true account thereof when thereunto required.
