Mabbett ---------------------------------------------- [p. 158] The Ninth day of the fifth Month in the year of our lord one thousand seven hundred ninety and six I Joseph Mabbett of the town of Washington in Dutchess county and state of Newyork [sic] being of sound mind and memory do make and ordain this my last will and testament, for the disposal of the co-[hate?] of which I am possessed after my decease Viz Imprimis I give and bequeath to Jemima Mabbett my beloved wife My black mare and riding chair at her own disposal, also the annuity or yearly income of seventy pounds, currant [sic] and lawful money of the state of newyork [sic], in lieu of her dower, or thirds to be paid her in the manner following Viz seventy pounds within one month after my decease, and seventy pounds yearly thereafter during the time she shall remain my widow; also the value of the household furniture which she brought with when she came to live with me as my wife at her own disposal. Item; I give and bequeath to my daughter Sarah Mabbett as much of my household furniture (or the value thereof in money) which shall be deemed of equal Value with the furniture which I gave to each or either of my daughters Jane Mott and Hannah Merritt, when they went to live with their husbands Item The sum of forty pounds I give and bequeath to the prefra[illeg]tive Meeting of Nine- partners to be appropriated to the use of the poor members of that meeting as the said meeting shall see fit to direct. Item; the remaining part of my estate both real and personal, I give and bequeath to my children and grand children hereafter named to be divided among them in the following manner Viz To my son Jonathan Mabbett one seventh part To my son Titus Mabbett and his son and daughter Samuel Mabbett and Phebe Mabbett one seventh part; Titus to have one half of the said portion; and the other [illeg] thereof to be divided between [illeg] said Samuel and Phebe in (such) [p. 159] such a manner that Samuel,s [sic] part may be in proportion to Phebe,s [sic] as two is to one, which parts shall be paid to said Samuel and Phebe when they shal [sic] arive [sic] to lawful age; and it is my will that Titus shall have the use of their said parts, untill [sic] they arive [sic] to lawful age. To my son Richard Mabbett one seventh part To my son Israel Mabbett one seventh part To my son John Mabbett one seventh part. To my daughter Mary Ketcham, and her sons and daughters Israel Ketcham, James Ketcham, Pilip [sic] Ketcham, [Lebulon?] Ketcham, Joseph Ketcham, David Ketcham, Hannah Ketcham, Sarah Ketcham and Mary Ketcham, One fourteenth part, to be divided among them in such a manner; that the portions of my said daughter Mary Ketcham and my grand children Israel Ketchum, James Ketcham, Philip Ketcham, [Lebulon?] Ketcham, Joseph Ketcham, David Ketcham and Sarah Ketcham may be in proportion to the parts or portions of my said grand daughters Hannah Ketcham and Mary Ketcham as two is to one, which said portions or legacies shall not be paid to my said grand children before they respectively shall arive [sic] to lawful age, and provided any or either of them shall decease before they arive [sic] at the age aforesaid it is my will if they leave no issue the surviving children their Brothers and sisters shall have the said portion or portions of the said deceased divided among them in proportion to their several legacies or bequests. And it is also my will that my said daughter Mary shall have the use of the portions hereby bequeathed to her said children untill [sic] they shall each of them arive [sic] to lawful age. To my daughter Jane Mott one fourteenth part To my daughter Hannah Merritt One fourteenth part and To my daughter Sarah Mabbett one fourteenth part not to be paid to her before she shall arive [sic] to lawful age. It is also my will if my said daughter Sarah Mabbett shall decease before she shall arive [sic] to lawful age [or?] without issue her abovesaid portion shall be divided among her above named Brothers and sisters in proportion to their above devised legacies or bequests. Lastly I do by these presents make and ordain constitute and appoint, Jonathan Mabbett, Richard Mabbett, and Israel Mabbett my sons above named and Samuel Mott of the town of washington executors to this my last will and testament and Authorize an [sic] enjoin them to collect the debts due to my estate pay my Just debts and sell my estate both real and personal, by publick [sic] Auction or private sale as shall appear to them most eligible; (such part of my personal estate as is hereby particularly bequeathed to my wife and daughter Sarah excepted) as soon as convenient not exceeding two years after my decease; and out of the monies thence arising together with the money collected as debts due to my estate to pay off the several legacies by this my last will bequeathed. [sic] Be it remembered that on the eighth day of May one thousand seven hundred and ninety nine personally appeared before me Gilbert Livingston surrogate of the said county John Titus of the town of Washington in said county former who on his solemn affirmation declared that he did see Joseph Mabbett sign and seal the annexed written instrument purporting to be the will of the said Joseph Mabbett bearing date the ninth day of the fifth month one thousand seven hundred and ninety six and heard him publish and declare the same as and for his last will and testament that at the time [illeg] he said Joseph Mabbett was of sound disposing mind and memory to the best of the knowledge and belief of him the affirmant and that Eleanor Stone Cornelius Haight Joseph S. Mabbett and the affirmant severally subscribed the said will as witness thereto in the testators presence Gilbert Livingston "F.S." [sic] The people of the state of Newyork [sic] by the grace of good free and Independent: to all to whom these presents shall come or may concern send greeting: Know ye that at poughkeepsie [sic] in Dutchefs [sic] county on the eighth day of May one thousand seven hundred and ninety nine before Gilbert Livington Esq. surrogate of our said county the last will and testament of Joseph Mabbett deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us; the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Jonathan Mabbett Richard Mabbett Israel Mabbett and Samuel Mott the executors on the said will named they being [p. 161] first duly affirmed will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed.
