C page 249 In the Name of God Amen the twenty second day of December one thousand eight hundred and one. I Barent Van Kleeck of Fishkill town in Dutchess County and State of New York being sick and weak of Body but of perfect Mind and Memory thanks be given unto God. Therefore calling unto mind the Mortality of my Body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament, that is to say principally and first of all I give and recommend my Soul into the hands of God that gave it and my Body I recommend to the Earth to be buried in decent Christian Burial at the discretion of my Executor nothing doubting but at the general Resurrection I shall receive the same again by the Almighty Power of God, And as Such worldy Estate where with it hath please God to bless me with in this life I give, demise and dispose of the same in the following manner and form. First in case my wife Molly shall survive me she shall hold the possession of all my Estate both real and personal for and during her life makes of my lands in such manner as she shall think most proper for her support (remembering that all my just debts shall be paid out of my personal estate, but shall in no wise ? any waste with the timber more than necessary for the support of fires and farm. Secondly I give unto my son Michael Van Kleeck five pounds for his birthright. I also order all my Estate both real and personal to be sold by my Executors after the death of my said wife Molly and the money arising from said property to be divided and used as follows. The one fourth part of said monies shall be put out at lawful interest with good land security, interest of which said fourth part shall be paid unto my said son Michael yearly during his life and at his said Michael's decease the principle sum come to his children or lawful heirs part of the monies coming by the sale of said property. I order it be put out as before mentioned for my grand daughter [?] DeGroff daughter of my daughter Dearity? Who was wife of Gideon DeGroff. One fourth part of said sale money as above? Unto my granddaughter Polly Ferdon daughter of my daughter Polly who was wife of William Ferdon which too last mentioned fourth parts or the Interest of them shall be applied to the bringing up said children until they shall become of age at which time if my said wife Molly is dead they shall receive the principle but if they or either of them shall die before they become of age then their money or legacy shall come to my other children in equal proportion unto my daughter Besty wife of Benjamin Van Dewaters and to her heirs I give also one fourth part of the money that arise from the sale of said property with any condition. Let be remembered that the three legacies first mentioned shall be put on good land Security by my Executors and the Interest applied as is above mentioned. I also constitute make and ordain my loving wife Molly my son in Law Benjamin Van Dewater and Peter Cornell my Executors to this my last will and testament and I do hereby disallow revoke and disannul all and every other former wills and testaments legacies and bequests and Executors by me in any ways before named willed and bequeathed Ratifyng and confirming this and no other to be my last will and testament. Dutchess County JS: Be it remembered that on the fifteenth day of October one thousand eight hundred and eight personally appears before me James Tallmadge, Jun. Surrogate of the said county of Dutchess (John M Cook) who on his oath declares that he did see Barnet Van Kleeck sign and seal the annexed written instrument purporting to the will of the said Barent VanKleeck bearing date the twenty second day of December one thousand eight hundred and one and heard him publish and declare the same as and for his last will and testament. That at the time thereof he the said Barnet Van Kleeck was of sound disposing mind and memory to the best of the knowledge and belief of the deponent and that this deponent Michael Weaver and Barnet DeGroff severally subscribed the will as witnesses thereto in the testators presence James Tallmadge Junior Surrogate__ The people of the State of New York, by the Grace of God free and Independent: Top all to whom these presents shall come or may concern send greeting: Know ye, that at Poughkeepsie, in Dutchess County on the seventeenth day of October in the year of our lord one thousand and eight hundred and eight before James Tallmadge Junr Esquire Surrogate of our said county the last will and Testament of Barent Van Kleeck deceased, a copy of which is here unto annexed was proved and is now approved and allowed by us and the said deceased having He lived and at the time of his death, Goods, Chattels within this State By means whereof the proving and registering the said will and the granting Administration of all and ? the said goods, Chattles and Credits and also the auditing allowing and final discharging the account thereof, doth belong unto us; The administration of all and singular the Goods, Chattles and Credits of the said deceased and anyway concerning his will is granted unto Peter Cornell and Benjamin Van Dewater, two of the Executors in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all credits singular the said goods, chattels and credits and also to render a just and true account thereof when there unto required. In testimony whereof we have caused the Seal of office? Surrogate to be herewith affixed.
