Imprimus, I give and bequeath to my beloved wife Patience Pierson the one moiety or equal half part of my estate both real and personal to be by her possessed during the time of her natural life. Item, I give and bequeath to my granddaughter Phebe Pierson the remaining money or equal half part of my estate both real and personal to be possessed by her and her heirs and assigns forever, and it is also my will that the watch and chest which my son Samuel her late father left shall be delivered to her as a part of her property in the said division together with one bed and furniture. And I further will and ordain that my said granddaughter Phebe shall be supported, brought up, and educated by means of the annual income or use of the property bequeathed to her as above said until she should arrive to lawful age, at which time all and singular the said property is to be delivered to her; and it is likewise my will that if said granddaughter Phebe should die before she arrives to lawful age and without issue that the property herein bequeathed to her shall be equally divided between the surviving children of my daughter Phebe Heusted the wife of Moses Heusted whose names are hereafter mentioned, and in case my said granddaughter Phebe should die without issue after she shall have arrived to lawful age, it is my will that the property hereby bequeathed to her shall descend to the children of my said daughter Phebe Heusted and be equally divided among them as above said. Item, I give and bequeath to Rachel Heusted, Sarah Heusted, Samuel Heusted, Jonathan Heusted, and James Heusted my grandchildren, the sons and daughters of Moses and Phebe Heusted to them, their heirs, and assigns forever all and singular the money or equal or half part of my estate above bequeathed to my wife during the term of her natural life, to revolve to and be equally divided among them after the decease of my said wife, and it is also my will that in case any or all of my said grandchildren shall be in their none age or minority at the time of the decease of my said wife that my said daughter Phebe shall have the use of their respective portions until they arrive to lawful age: and in case any of my said grandchildren shall die before they come to lawful age and without issue that the portions hereby bequeathed to them shall be equally divided between their surviving brothers and sisters. Lastly, I make and ordain, constitute and appoint my son-in-law Moses Heusted above named and my friend William Tabor of the town of Pawlings executors to this my last will and testament; and I do hereby utterly disavow and revoke all former wills and testaments by me heretofore made, declaring this and no other to be my last will and testament. In witness whereof, I have hereunto set my hand and seal the day and year first abovewritten. Stockholm Surrogate of the said county James Haight who on affirmation declared that he did see Samuel Pierson sign and seal the annexed written instrument, purporting to be the will of the said Samuel bearing date the thirteenth day of first month one thousand eight hundred and six and heard him publish and declare the same as and for his last will and testament, that at the time thereof he the said Samuel was of sound disposing mind and memory to the best of the knowledge and belief of him the affirmant. And that Samuel Mott, Catharine Gowers, and this affirmant severally subscribed the will as witnesses thereto in the testator's presence. Derick B. Stockholm The people of the State of New York, by the Grace of God Free and Independent, to all to whom the presents shall come or may concern, send Greetings: Know Ye that at Poughkeepsie, in Dutchess County, on the tenth day of June in the year of our Lord one thousand eight hundred and sixteen before Derick B. Stockholm Esquire Surrogate of our said county the last will and testament of Samuel Pierson deceased (A copy whereof is hereunto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death, Goods, Chattels, or Credits within this state, by means whereof the proving and registering the said will and the granting administration of all and singular the said Goods, Chattels, and Credits, and also the auditing, allowing, and final discharging the account thereof, doth belong unto us; the adminisration of all and singular the said Goods, Chattels, and Credits of the said deceased, and any way concerning his will is granted unto Moses Heusted and William Tabor the executors in the said will named they being first duly affirmed well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said Goods, Chattels, and Credits, and also to render a just and true account thereof when required. In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness Derick B.
