I Samuel Sacket of the town of Stanford in Dutchess County and State of New York, being in health of body and of sound disposing mind and memory, knowing that is appointed to ___ to die, do make and publish this, my last will and testament in manner following. That is to say, I give to my well beloved wife, Thankful the imp___ of one third of all my lands during her natural life. I also give to her, my said wife, all my household furniture and two cows, all which is for and in lieu of her dower, which I desire her to accept accordingly. I give and bequeath to my son Samuel Sacket Junior, seven hundred and fifty dollars and likewise all obligations which I may hold against him at the time of my decease. I give and bequeath to my daughter Hannah, wife of Matthew Scott, five hundred dollars, including one hundred and twenty dollars in an obligation which I hold against her said husband. That is to say, three hundred and eighty dollars exclusive of said obligation. I give and bequeath to my daughter Phebe, wife of James Germond, five hundred dollars. I give and bequeath to my daughter Polly, wife of ____Row, five hundred dollars. I give and bequeath to my daughter Betsey, wife of Derias _____five hundred dollars. All which legacies to my above named children to be paid to them respectively, at the time and in the manner herein directed. I give and devise to my two sons, to wit. Joel Sacket and Isaac Sacket, all my lands and tenements which I now hold and possess and whereon I now reside, to them, their heirs and assigns forever in the following manner and proportion. That is to say, to Isaac solely, the barn on the east side of the highway and a quarter of an acre of land whereon it stands, to be run off at equal distances there from on the north east and south sides and on the west side by the said highway and also the land and building on the west side of said highway, contained within the following descriptions. To wit, beginning on the west side of said highway, northwesterly from the said barn so far south as that a line running west will clear the most southerly building one rod and so far west that a north line will run one rod west of the most westerly building herein to be included, thence north so far that an east line will run one rod north of the dwelling house, then east to the said highway and along the highway to the place of beginning. And the residue and remainder of all my lands as above described to them, the said Joel Sacket and Isaac Sacket in equal shares, but subject however to the following directions and payments to wit. I order and direct that my said son Isaac, maintain and provide for my sister Ester in a proper manner during her life time and if he does not so maintain her, I direct my herein after Executors to provide such maintenance and charge him, the said Isaac therewith, which charges I direct him to pay.______ I order and direct my two said sons Joel and Isaac to whom I have devised my lands equally, to pay all the herein before bequeathed legacies, as far as I have given them in money. __ I order and direct them, the said Joel and Isaac to pay to my three last named sons, Jehiel, Samuel and James, two thirds the interest on each of their sums respectively, yearly after my decease, till the decease of their mother. And thereafter pay the principal sums in four yearly equal payments to each of ____ , the first payment to be made within one year after the decease of my said wife and so yearly and every year till the whole is paid, with full interest on the three last payments, yearly to commence at the end of one year from my said wife's decease. __ In like manner, I order and direct my said two sons, Joel and Isaac to pay to my said three daughters to wit. Hannah, Phebe and Betsy, two thirds of the interest yearly after my decease, till the decease of my said wife and after the death of my said wife, to pay the whole interest to each of them respectively, yearly during the lives of their said husbands and if they or either of them survive their said husbands, I order and direct them, the said Joel and Isaac to pay the whole sum as above bequeathed to them in two equal yearly payments. But if they or either of them die before their said husband, then and in that case, the whole of the said legacy so far as it respects such one so dieing to go to her surviving children equally, to be paid to them severally when they arrive to lawful age with interest yearly. Whereas I have let my said daughter Polly's said husband have the sum of five hundred dollars, the amount of her legacy herein bequeathed to her for which sum I hold his obligation. I direct my herein after named Executors at my decease to give up the said obligation to her, my said daughter Polly, which is to pay her said legacy. __I order and direct my said Executors to pay all my just debts and funeral expenses out of my personal property and the remainder and residue thereof, I give equally to all my said children of what kind soever, my property may consist. And I hereby constitute and appoint my two said sons, Jehiel Sacket and Samuel Sacket junior, Executors of this, my last will and Testament. ___In witness whereof, I have hereunto set my hand and seal, the twenty first day of April, in the year of our Lord, one thousand, eight hundred and twelve. Signed, Sealed, Published and Declared by the said Samuel Sacket as and or his last Will and testament, in the presence of us, Samuel Sackett who have hereunto subscribed our names and witnesses in the presence of the Testator. Jesse Thompson, Gurdon Miller, Jesse P. Thompson Dutchess County. Be it remembered that on the third day of September on thousand eight hundred and sixteen, personally appeared before me, Derick B. Stockholm, Surrogate of the said County, Jesse Thompson who on oath declared that he did see Samuel Sackett sign and seal the annexed written instrument purporting to be the will of the said Samuel, bearing date the twenty first day of April, one thousand eight hundred and twelve and heard him publish and declare the same as and for his last will and testament. That at the time thereof, he, the said Samuel Sacket was of sound, disposing mind and memory, the best of the knowledge and belief of him, the Deponent. And that Gurdon Miller, Jesse P. Thompson and this Deponent severally subscribed the will, as witnesses thereto in the Testators presence. Derick B. Know Ye, that at Poughkeepsie, in Dutchess County on the third day of September in the year of our Lord, one thousand eight hundred and sixteen, before Derick B. Stockholm Esquire, Surrogate of our said County, the last will and testament of Samuel Sackett, deceased, (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular, the said goods, chattels and credits and also the auditing, allowing and final discharging the account thereof, doth belong unto us, the administration of all and singular, the goods, chattels and credits of the said deceased and any way concerning his will is granted unto Jehiel Sacket and Samuel Sacket Junior, the Executors in the said will named they, being first duly sworn and affirmed, well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular, the said goods, chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof, we have caused the seal of office of our said Surrogate, to be hereunto affixed. Witness, Derick B. Stockholm Esq., Surrogate of the said County at Poughkeepsie, the third day of September in the year of our Lord one thousand eight hundred and sixteen and of our Independence the forty first.
