I Samuel Howland of the Town of Washington in the County of Dutchess and State of New York being of sound mind and memory and in good health and mindful of my own mortality do make and publish this my last will and testament in manner and form following viz. Firstly. I do order that all my just debts and funeral charge be paid out of my real estate. Secondly. I do order that three hundred and forty dollars be paid unto my son Jonathan Howland of the County of Saratoga out of my real estate also as a legacy to him and his heirs which is to be paid to him or his heirs as the case may be within one year or sooner after my decease. In the third place I give to Pontius and Solomon Howland son of Solomon Howland of the aforesaid town deceased the residue of all my estate in equal shares share and share alike and lastly I appoint my son-in-law Peter Fish of Amenia Town in the aforesaid County as my executor with full and power to divide my said estate as he shall think proper according to the beforegoing gifts by selling and dividing the avails or any way he shall think proper after my decease. In witness whereof I have hereunto set my hand affixed my seal this 22nd day of November in the year one thousand eight hundred nineteen. Peter Barton Junior mark Whereas I Samuel Howland of the Town of Amenia have made my last will and testament in writing bearing the date 22nd day of November in the year 1819 and thereby given Solomon Howland an equal share of my estate with Pontius Howland - Now I do by this my writing which I hereby declare to be a codicil to my said will to be taken as a part thereof will and direct that the share given in my will to Solomon Howland shall be hereby given to Pontius Howland and lastly it is my desire that this my presen codicil be annexed to and made part of my last will and testament to all intents and purposes. In witness whereof I have hereunto put my hand and seal this 5th day of May in the year of 1822. his Samuel X Howland mark Signed and sealed and published and declared by this above named Samuel Howland as a codicil to his said last will and testament in the presence of Peter Fish Junior, Ann Fish, Polly Kent. I Samuel Howland of the Town of Amenia have made a codicil to my last will and testament bearing date the fifth day of May in the year 1822 in which I ordered that Pontius Howland should share the part of my estate in whole that was given to Solomon Howland in my will I now revoke and order that my last will and testament shall stand good and the codicil cease from any effect in witness whereof I have hereunto set my hand and seal this eighteenth day of March 1823.
