State of New York Dutchess Surrogate Court In the matter of proving the will of Susan Seaman deceased Dutchess County Surrogate Office ss: Be it remembered that heretofore upon due application for that purpose to the surrogate of said Dutchess County citations were issued by said surrogate to the heirs and next of kin of said deceased which said citations with the admissions and proofs of service they were hereafter returned to said surrogate and area as follows to wit: The people of the State of New York, by the grace of God free and independent, To all whom these presents shall come and may concern, and especially to John Gilbert Freelove his wife and Julia A. Bonesteel Surrogate I admit due service of the within citation December 16^th 1846 Braddock Seaman Dutchess County: Jacob Seaman being duly sworn says that he enclosed the within citation to Braddock Seaman in a letter that was returned to him with the above admissioned signed that he knows the hand writing of said Braddock, has seen him write and believes the signatures to said admission to be in the hand writing of the said Braddock Seaman. Jacob Seaman Sworn this 26^th day of January 1847 before me V.D. Bonesteel Surrogate And thereupon the said last will and testament with the probate thereof were produced and are as follows to wit: I Susan Seaman of the town of Washington, County of Dutchess, being in feeble health but of sound disposing mind and memory do make this my last will and testament. 1^st I give and bequeath all my right title and interest in and to the farm now occupied by my brother Herrick Seaman situate in the town of Washington county of Dutchess to my three sisters in equal shares. viz: to my sister Phebe Seaman on equal undivided third part of my interest in said farm and to my sister Eliza Seaman one equal and undivided third part, and the remaining third part I give and bequeath to my sister Sarah K. Seaman to them their heirs and assigns for ever ? I also will and direct my executor whom I shall hereafter name to collect all moneys that may be due me at the time of my decease and to pay all just demands and funeral expenses. In order that my will may be duly executed and carried out I constitute and appoint my brother Jacob Seaman as my sole executor to this my last will and Testament revoking all former wills by me made. Redfield of Washington Dutchess County State of New York Dutchess Surrogate Court In the matter of proving the last will and Testament of Susan Seaman deceased Dutchess County ss: Jacob Seaman of the town of Washington in the county of Dutchess being duly sworn and examined deposes and says that the circumstances as far as this deponent knows, and is able to state them relating to the executions, the delivery, and the possession of the Testament in writing now produced and shown to this deponent purporting to be the last will and testament of Susan Seaman deceased the above named testator bearing date the 2^nd day of September in the year one thousand eight hundred and forty five are as follows to wit: that this deponent was present at the time of the executing and publishing of the said Will by the said testatrix and knows that the same was executed and published by the said testatrix in the presence of the subscribing witnesses thereto at or about the time it bears date. That this deponent received the same from his sister in a sealed envelope some time after testatrix?s decease and that it remained in the care and custody of the deponent until he delivered it to the surrogate sealed in said envelope for the purpose of having the same duly proved before this court and recorded according to law and that while the same remained in the care and custody of this deponent as aforesaid, it was in no respect altered or changed and that is now to all appearances in the same condition as when first received by this deponent as above set forth. Bonesteel Surrogate State of New York Dutchess Surrogate Court In the matter of proving the last will and Testament of Susan Seaman deceased Dutchess County p: Isaac Haight junior of the town of Washington in the county of Dutchess being duly affirmed and examined doth depose and say, that this deponent was well acquainted with Susan Seaman the above named testatrix late of the town of Washington in the county of Dutchess, deceased. That this deponent was present as a witness, and did see the said testator subscribe at the end thereof, the instrument now produced and shown to this deponent purporting to be the last will and Testament of the said deceased bearing date the second day of September in the year of our Lord one thousand eight hundred and forty five. That the said testatrix at the same time declared the instrument so subscribed to be her last will and testament. That thereupon the deponent and Robert B. Redfield severally subscribed their names at the end thereof as witnesses thereto, at the request of the testatrix and her presence and that the said testatrix at the same time of recounting and publishing the said last will and Testament was of full age, of sound mind and memory and not under any restraint. Redfield of the town of Washington in the county of Dutchess, being duly sworn and examined doth depose and say that this deponent was well acquainted with Susan Seaman the above mentioned testatrix late of the town of Washington in the County of Dutchess, deceased. That this deponent was present as a witness and did see the said testatrix subscribe at the end thereof the instrument now produced and shown to this deponent, purporting to be the last will and Testament of the said deceased bearing date the second day of September in the year of our Lord one thousand eight hundred and forty five. That the said testatrix at the same time declared the instrument so subscribed by her to be her last will and Testament. That thereupon the deponent and Isaac Haight, jr. severally subscribed their names at the end thereof as witnesses thereto at the request of the testatrix and in her presence: and that the said testatrix at the time of execution and publishing the said last will and Testament was of full age and sound mind and memory, and not under any restraint. Bonesteel surrogate On this twenty fifth day of January 1847 the proof and examination of the witnesses to the will of Susan Seaman deceased having been duly taken and file, and it appearing satisfactorily to this court from the proofs so taken that the will of said deceased was duly incanted and that said testators at the time of incanting publishing the same was in all respects competent to devise his estate and not under any restraint and this court being satisfied of the genuincey and validity of said will it is ordered that said will and the proofs and examinations taken thereon be recorded in this office.
