Be it remembered that heretofore upon due application for that purpose to the Surrogate of the County of Dutchess citations were issued by said Surrogate to the heirs and next of kin of said deceased; which said citations and proofs of service thereof were thereafter duly returned to said Surrogate; And the proper parties being in court such proceedings were thereupon had that the said Surrogate took the proofs of the said last Will and Testament which said last Will and Testament and the proofs aforesaid are as follows that is to say The Last Will and Testament of Ebenezer Punderson now of the Town of Red Hook County of Dutchess and late of the City of Hudson County of Columbia, Being mindful of my mortality do make and publish this my last Will and Testament as follows (viz.) 1- after my death to be decently buried without any funeral pomp and with as little expense as may be the head stone at my grave to be no larger than the one at the grave of my deceased wife at Red Hook aforesaid. After my funeral charges and all my debts are paid, I give and bequeath unto my daughter Betsy the interest [page 136] of two thousand Dollars to be paid to her annually during her life and after her death the said two thousand Dollars to be equally divided in three parts one part to be paid to my son Ebenezer Punderson one third part to my Grand Son John Punderson Wheeler and the remaining one third part to my Grand Son James Mellen Punderson. Also I give and bequeath to my daughter Mary, the wife of Gamaliel Wheeler the sum of ten Dollars, also to James Punderson Mellen my Grand Son ten Dollars, also to my daughter Prudence Henderson [note: should be Handerson - jrp] ten Dollars, also I give and bequeath to my son Frank Punderson my desk and Iron chest, also I give and bequeath to my son Ebenezer Punderson all my wearing apparel Bedsted Bed and Bedding one tea Table one stand and Books one chest and two Trunks, one large easy chair and all my other chairs Bottles and other Crockery my Clock is his by contract, but to remain with me during my life or pleasure, also I devise and bequeath unto my three sons (viz) Frank, Ephraim and Ebenezer their heirs and assigns all the remainder and revenue of my estate both real and personal and not otherwise disposed of. I do hereby appoint Frank Punderson my son, Cyrus Curtiss of the city of Hudson and my son Ebenezer F. Punderson, Executors to this my last Will and Testament and I do hereby give the said Executors or any two of them, full power to sell all or any part of my real or personal estate and divide and distribute the amount of sales (deducting all necessary expenses) agreeably to the foregoing bequeathments which cannot be paid until the Executors are in funds to pay the same - Hereby revoking all former will and Wills codicil and codicils by me heretofore made and Executed. Signed and sealed by the Testator this twenty fifth day of august at Red Hook aforesaid and in the year of our Lord one thousand eight hundred and forty six and declared by him to be his last Will and Testament and he then acknowledged to each of us that he had subscribed the same and we at his request sign our names hereto as attesting Witnesses. State of New York Dutchess Surrogate Court In the matter of proving the last Will and Testament of Ebenezer Punderson deceased Dutchess County SS: John V. A. Lyle of the Town of Red Hook in the County of Dutchess being duly sworn and examined, doth depose and say, that this deponent was well acquainted with Ebenezer Punderson the above named testator late of the town of Red Hook in the County of Dutchess deceased. That this deponent was present as a witness and did see the said Testator subscribe [page 137] at the end thereof, the Instrument now produced and shown to this deponent purporting to be the last Will and Testament of said deceased, bearing date the twenty fifth day of August in the year of our Lord one thousand eight hundred and forty six. That the said testator at the same time declared the instrument so subscribed by him to be his last Will and Testament. That thereupon the deponent and Gottlob Haas severally subscribed their names at the end thereof as witnesses thereto, at the request of the testator and in his presence; and that the said testator at the time of executing and publishing the said last Will and Testament, was of full age of sound mind and memory, and not under any restraint. John V.A. Lyle Sworn this 11th day of August 1847 before me Jno. P. H. Tallman Surrogate State of New York Dutchess Surrogate Court In the matter of proving the last Will and Testament of Ebenezer Punderson deceased Dutchess County SS: Gottlob Haas of the Town of Red Hook in the County of Dutchess being duly sworn and examined, doth depose and say, that this deponent was well acquainted with Ebenezer Punderson the above named testator late of the town of Red Hook in the County of Dutchess deceased. That this deponent was present as a witness and did see the said Testator subscribe at the end thereof, the Instrument now produced and shown to this deponent purporting to be the last Will and Testament of said deceased, bearing date the twenty fifth day of August in the year of our Lord one thousand eight hundred and forty six.
