Osgood late of the town of Elizabethtown in the county of Essex, and State of New York deceased proved and admitted to probate April 26th 1880. Will I, Solomon W. Osgood of Elizabethtown Essex County New York, aged 70 years being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament that is to say: First. After all my lawful debts are paid and discharged, I give, devise and bequeath what may remain of my property – real as well as personal to my beloved wife Ann Osgood for and during the full end and term of her natural life with full right and power to sell dispose of and convey any and all of such property and to invest & reinvest the proceeds of such sale or sales on interest with the right to use the same - principal and interest, as far as may be necessary for her support & maintenance as long as any part thereof may or shall remain, with remainder over, if any there shall be at her death, to my son David Wilbur Osgood his heirs and assigns forever. Likewise, I make, constitute and appoint my said wife Ann Osgood to be executrix of this my last Will and Testament hereby revoking all former Wills by me made. In witness whereof, I have herewith subscribed my name and affixed my seal, the 28th day of May in the year of our Lord one thousand eight hundred and seventy eight. Solomon W. Osgood LS: The above instrument, consisting of one sheet was at the date thereof subscribed by the testator Solomon W Osgood in the presence of us and each of us: & he at the time of making such subscription, acknowledged that he made the same, and declared the said instrument so subscribed by him to be his last Will and Testament. Whereupon we then and there, at his request, and in his presence and the presence of each other, subscribed our names as witnesses thereto. Byron Pond residing at Elizabethtown N.Y. Geo. S. Nicholson residing at Elizabethtown N.Y. Depositions Surrogate’s Court, County of Essex: In the matter of proving the last Will and Testament Of Solomon W. Osgood Deceased County of Essex, SS: Byron Pond & George S. Nicholson being duly severally sworn and examined as witnesses before Francis A. Smith Esquire, Surrogate of the County of Essex depose and say, and first the said Byron Pond says that he resides in the town of Elizabethtown in said County of Essex and State of New York, and is a lawyer and is aged fifty years & upwards, and the said George S. Nicholson says that he resides in the town of Elizabethtown in said County and State and is a Justice of the Peace and is aged fifty years and upwards, and each for himself further says that he was well acquainted with Solomon W. Osgood now deceased, that deponents were present as witnesses, and did see the above named Solomon W. Osgood subscribe his name at the end of the instrument in writing, now produced and shown to these deponents; bearing date the 28th day of May in the year one thousand eight hundred and seventy eight purporting to be his last Will and Testament. That the said decedent at the time of making the said subscription, declared the said instrument to be his last Will and Testament, and requested these deponents to sign their names as witnesses whereto thereupon these deponents accordingly signed their names as witnesses at the end of the said instrument, in the presence of the said decedent and of each other; and each for himself further says, that the said decedent, at the time he so executed the said instrument was, as deponents believes, a citizen of the United States, of full age of sound mind and memory, in all respects competent to devise real estate, and not under any restraint. And the said Byron Pond further says that he drew said will pursuant to the instructions of the said deceased and carefully read the same to him before he executed the same. Smith Surrogate State of New York County of Essex SS: I Francis A Smith Surrogate of the County of Essex do hereby certify the foregoing to be a true copy and record of the last Will and Testament of Solomon W. Osgood late of the town of Elizabethtown in said County deceased propounded for probate and this day proved as a will relating to both real and personal estate together with the proofs and examinations taken before me in relation to the execution thereof. David Osgood b 1774 d 1848 in Elizabethtown NY is who I am looking for information on and is my relative.
