Surrogate Court, Franklin County. Be it remembered, That heretofore to wit; On the 14th day of June 1893, Willard J. Saunders, sole executor named in the Last Will and Testament of Laura Kingsley, late of Waverly, in the County of Franklin, deceased, applied to the Surrogate of the County of Franklin to have the said last Will and Testament which relates to both real and personal estate, proved and recorded: and in such application the said Surrogate did ascertain by satisfactory evidence, who were the legatees, devisers, heirs at law, next of kin, husband, wife, executors and trustees of said deceased testator and their respective residences, viz: Almon Kingsley, Daniel Kingsley, Betsey Cilley and Amos Kingsley, all residing at Dickinson, NY and Herbert F. Cook, Frank O. Cook, Lillian L. Cook, Zara L. Cook, Rosa C. Cook, Grace L. Cook, Edward W. Cook, and Harley L. Cook, all residing at Waverly, NY and said surrogate did thereupon issue a citation in due form of law, directed to the said legatees, devisees, heirs at law, next of kin, husband, wife, executors and trustees by their respective names stating their places of residence requiring them to appear before the said Surrogate at his office in Malone Village in said County on the 3rd day of July A.D. 1893 at 10 o’clock A.M. to attend the probate of said Will and a supplemental citation having been issued to the said Harley L. Cook, he not having been served with the said original citation and afterwards, to wit on the 24th day of July 1893, at Malone Village aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of the said citation in the mode prescribed by law on all said above named persons and Michael J. Scanlon, Counselor at Law, appearing for the infants, Herbert F. Cook, Frank O. Cook, Lillian L. Cook, Zara L. Cook, Rosa C. Cook, Grace L. Cook, Edward W. Cook and Harley L. Cook, and no one appearing to oppose the probate of said Will, the said Surrogate took the proofs of said Will hereinafter set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, and that the said Will and the proofs thereof to be recorded; which said last Will and Testament and the proofs taken thereon are as follows, that is to say: Will I, Laura Kingsley, of the town of Waverly, County of Franklin in the State of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and testament, that is to say, First, After all my lawful debts are paid and discharged, I give and bequeath to my husband, Almon Kingsley the use of all my real and personal property during his natural life in lieu of all right and interest that he might have and hold in my estate at my decease. Said property both real and personal I will and desire to be under the control and in the charge of my executor hereinafter named, during the life of my said husband Almon Kingsley. Second: At the death of my said husband, it is my Will, wish and desire that all my property both real and personal be equally divided between my children Daniel Kingsley, Clara Cook, Betsey Kingsley and Amos Kingsley share and share alike. Third: I do hereby give to my executor hereinafter named full power and authority to sell, dispose of and by a good and sufficient deed convey all or any part of my said property or real estate if in his judgment he shall deem it for the best interest of my estate to sell and dispose of the same. Likewise, I make, constitute and appoint Willard J. Saunders of the town of Dickinson, NY to be sole executor of this, my last Will and Testament hereby revoking all former Wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal this eight day of August, 1891. Dawless, Dickinson, Franklin Co., NY Surrogate’s Court, County of Franklin, New York In the matter of the last Will and Testament of Laura Kingsley, Deceased Examination of witnesses produced, sworn and examined in the above entitled matter County of Franklin ss: Nelson E. Kingsley and George Bradley being severally and duly sworn and examined before Hon. Samuel A. Beman, Surrogate of the County of Franklin, on behalf of the applicant to prove said Will, do each depose and say as follows: We were each well acquainted with Laura Kingsley deceased. That subscription of the name of the said decedent to the instrument now shown to us and offered for probate as her last Will and Testament and bearing date of the 8th day of August in the year of our Lord one thousand eight hundred and ninety one was made by decedent at the residence of Daniel Kingsley in Dickinson in presence of us and each of us, subscribing witnesses to said instrument. At the time of her making such subscription the said decedent declared the said instrument so subscribed by her to be her last Will and Testament, and we, the undersigned, thereupon subscribed our names as witnesses at the end of said instrument at the request of said decedent and in her presence and the presence of each other. That said decedent at the time of so executing said instrument was upward of the age of twenty one years, and a citizen of the United Sates and of sound mind, memory, and understanding and not under restraint, or in any way incompetent to devise real estate. Beman, Surrogate Franklin County, ss: It appearing from the proofs duly taken in respect to that last Will and Testament of Laura Kingsley, late of Waverly in the County of Franklin and State of New York, deceased: that the said Will was duly executed and that the said Laura Kingsley at the time she executed the same, was in all respects competent to devise real estate, and not under restraint, the said Last Will and Testament as a valid Will of real and personal estate and the proofs and examinations are hereby Recorded. Laura Kingsley's maiden name was "Bradley". She died 21 March 1893. Her husband, Almon Kingsley, died 21 Feb 1894.
