ISAAC’S HALF-BROTHER, Civil War Veteran ORSON LEROY REYNOLDS of FRANKLIN CO., NY, was named after their AUNT’S TWO SONS, namely ORSON SALISBURY and LEROY SALISBURY, both of GREENWICH, WASHINGTON, NY In 1796, EZRA and ISAAC LOVEJOY settled in NELSON, MADISON, NY ISAAC L. W. REYNOLDS OF BOMBAY, FRANKLIN COUNTY, NEW YORK : FRANKLIN SURROGATE’S COURT In the matter of proving the Last Will and Testament of ISAAC L. W. REYNOLDS deceased. Be it remembered that heretofore, to wit, On the thirtieth day of May in the year one thousand eight hundred and sixty six, CHARLES FRYE the EXECUTOR named in the Last Will and Testament of ISAAC L. W. REYNOLDS, late of the Town of BOMBAY, deceased, appeared in open court before the SURROGATE of the County of FRANKLIN and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved and on such application the Surrogate did ascertain by satisfactory evidence who were the WIDOW, HEIRS and NEXT OF KIN of the said Testator, and their respective residences; said Surrogate did thereupon issue a citation in due form of law directed to the said Widow, Heirs and Next of Kin, by their respective names, stating their respective places of residence, requiring them to appear before said SURROGATE at his Office in the Town of MALONE on the eleventh day of June, instant, to attend the probate of said will, and afterwards to <____> on the said eleventh day of June, satisfactory evidence by affidavit was produced and presented to said SURROGATE of the service of the said citation in the mode prescribed by law, and on that day it appearing that some of the said Heirs were Minors having no general guardian within this state, a Special Guardian was appointed in due form of law to take care of their interests in this matter, by an order entered for that purpose by said surrogate, which said Special Guardian was an Attorney At Law and was present to attend the probate of said will such proceedings were thereupon Had afterwards that the surrogate took the proof of said will hereinafter set forth, upon this eleventh day of June in the year one thousand eight hundred and sixty six: and he adjudged the said will to be a valid will of real and personal estate, and the proofs thereof sufficient: which said Last Will and Testament and Proofs are as follows, That is to say: WILL: In the name of God, Amen. I, ISAAC L. W. REYNOLDS of the Town of BOMBAY in the County of FRANKLIN and State of NEW YORK, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my LAST WILL AND TESTAMENT, That is to say: FIRST, After all my lawful debts are paid and discharged I give and bequeath to my SON LEEANDER TWENTY FIVE HUNDRED DOLLARS and INTEREST as follows, to wit, Within one year after my decease the said sum is to be securely invested on interest, said interest to be paid yearly, commencing one year from the date of said investment that of the first years interest, FORTY DOLLARS are to be paid immediately after collection to my said SON LEEANDER and the balance applied in payments for his schooling and clothing; if in the estimation of my EXECUTORS my said SON LEEANDER shall have made a good use of said FORTY DOLLARS then of the Second Years Interest I direct that ONE HUNDRED DOLLARS be paid him and the balance applied as above directed, and if my said SON shall have made a good use of said sums in the estimation of my EXECUTORS then and thereafter the WHOLE AMOUNT OF INTEREST to be paid to him yearly until He arrives to the age of TWENTY ONE YEARS when the said amount invested viz: TWENTY FIVE HUNDRED DOLLARS are to be paid to him. SECOND: I give and bequeath to EACH OF MY OTHER CHILDREN as follows, To Each BOY, ONE THOUSAND DOLLARS, To Each GIRL, FIVE HUNDRED DOLLARS in manner following, to wit, when EACH OF MY SAID OTHER CHILDREN shall have attained The AGE OF MY SON LEEANDER at the time of the investment of his bequest, the bequest of my said other CHILDREN shall be invested and disposed of in every respect the same as in the case of my SON LEEANDER and proportionally therewith. THIRD, I give and devise to my BELOVED WIFE ADALINE ONE THIRD OF ALL MY REAL ESTATE of which I may <___ _____>, in lieu of dower, during her natural life. FOURTH, I direct that said investments be made first from the sales of the personal estate secondly from the avails of the sales of the real estate of which I may <___ _____>, reserving and excepting the one third of all the real estate hereintofore given and devised to my WIFE ADALINE in lieu of dower during her natural life. FIFTH, I further give and bequeath to my WIFE ADALINE the use and occupancy of all my personal and real estate so long as she shall remain unmarried excepting and deducting the sales necessary to said investments as they become due providing she remains a householder and provides reasonably for the children. SIXTH, If after all the aforesaid gifts, bequests and devises shall have been cancelled there shall be any personal or real estate remaining it shall be divided equally among my CHILDREN, except LEEANDER, share and share alike. Likewise, I make, constitute and appoint my WIFE ADALINE REYNOLDS and CHARLES FRYE of the Town of FORT COVINGTON, FRANKLIN COUNTY N.Y. to be EXECUTRIX and EXECUTOR of this my Last Will and Testament, hereby revoking all former wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal the seventh day of October In the year of our Lord one thousand eight hundred and sixty five. ISAAC L. W. REYNOLDS deceased as a will of real and personal estate Examination of witnesses produced, sworn and examined before HENRY A. PADDOCK SURROGATE, in the above entitled matter. FRANKLIN COUNTY S.S. CHARLES T. RUSSELL and CLEMENT B. REYNOLDS both of BOMBAY in said County being each duly sworn do each depose as follows: I was well acquainted with ISAAC L. W. REYNOLDS now deceased. The subscription of the name of said deceased to the instrument now shown to me and offered for probate as his last will and testament and bearing date the seventh day of October 1865, was made by the deceased at the STORE OF JACOB G. REYNOLDS IN BOMBAY N. Y. in the presence of these deponents subscribing witnesses at the time of making such subscription the said deceased declared the said instrument so subscribed by him to be his Last Will and Testament, and I thereupon signed my name as a witness at the end of said instrument at the request of said deceased and in his presence. The said deceased at the time of so executing said instrument was upwards of the age of twenty one years, and of sound mind, memory and understanding and not under any restraint or in any respect incompetent to devise real estate. I, CHARLES RUSSELL saw said CLEMENT B. REYNOLDS sign his name as a witness at the end of said will and know that he did so at the request of said deceased and in his presence, And I, CLEMENT B.
