Quaw Franklin County, New York Volume 6, PP 376-383 In the matter of proving the Last Will and Testament of Delight M. Quaw, deceased Be it remembered that heretofore wit On the 10th Day of Oct 1877 Giles Russell the executor named in the Last Will and Testament of Delight M. Quaw late of Fort Covington deceased appeared in open Court before the surrogate of the County of Franklin & made application to have the said will which relates to both real & personal estate proved & on such application the surrogate did ascertain by satisfactory evidence who were the next of kin of the said deceased & their respective residences & some of them appearing to be minors said surrogate did thereupon issue citation directed to the heirs & next of kin [ ] them to appear before him at his office in Malone Village on the 10th day of December 1877 to attend the probate of said will, and on the 27th day of December 1877 such proceedings were thereupon heard. Afterwards that the Surrogate took the proof of the will hereinafter set forth on the 27th day of December 1877 and he adjudged the said will to be a valid will of real & personal estate which said Last Will and Testament & the proofs thereof are as follow that is to say Will In the name of God, Amen, I Delight M. Quaw of the Town of Fort Covington County of Franklin and State of New York being of sound mind and memory and disposing and understanding do hereby make publish and declare my last Will and Testament in manner and form following First I order and direct that my executor hereafter named pay all my just debts and financial charges as soon as after my decease as may consistently be done. Second I give and bequeath to my sister Charlotte Briggs' children three in number three hundred dollars apiece. Third Franklin P. Briggs the sum of three hundred dollars two hundred dollars I have paid over to him one hundred due. I give and bequeath to Charlotte A. Barry the sum of three hundred dollars two hundred dollars paid over and one hundred due. I give and bequeath to Martha J. [Rossete ?] the sum of two hundred and sixty-five dollars all paid over. Thirdly I give and bequeath to my sister Jerusha Norton's children five of them three hundred dollars apiece. I give and bequeath to Charles L. Norton the sum of three hundred dollars two hundred of it paid over one hundred still due. I give and bequeath to Lucius M. Norton the sum of three hundred dollars two hundred paid and fifty paid fifty due I give and bequeath to James Rodney Norton the sum of one hundred dollars instead of three. I give and bequeath to Mary D. Harris the sum of three hundred dollars fifty paid over two hundred due. I give and bequeath to Laura D. [Olney ?] the sum of three hundred dollars thirty paid over two hundred and seventy due. These are my sister Jerusha Norton's family. Fifth I give and bequeath to my sister Susannah Robinson's children two in number their names are Lucina E. A. Russell and Julia J. Barber. I give and bequeath niece Lucina E.A. Russell the sum of three hundred dollars one hundred and thirty two of it paid and one hundred and sixty eight due. I give and bequeath to Julia J. Barber the sum of three hundred dollars two hundred paid one hundred still due. I have receipts to show for what I have paid over which will be found in the box with the will. Sixthly If I own any real estate at my decease I order and direct and fully empower and authorize my executor to sell & convey the same and pay the proceeds towards the legacies herein named. The farm that I have a deed of that Myron Barber lives on in town of Westville and has a redemption lease of is to hold on ten years after my decease to give him a chance to pay for it by paying the rent annually and if at any time he wishes to sell it he can do so by paying over to my executors the sum of eighteen hundred dollars which I paid for it the remainder will belong to him. Seventhly I bequeath to Madison University { } for the use of indigent young men studying for the ministry to help them through with their studies. 8th I give and bequeath the Baptist Church where my name is enrolled as a member of that body the sum of five hundred dollars to be used for the support of gospel one hundred dollars per year payable the whole amount to be paid over to the Trustees of said Church as soon as collected by my Executors & the said Trustees are to hold it in trust till the whole amount is paid with interest. 9th I give and bequeath to my present husband John A. Quaw twelve hundred fifty dollars which he owes me for borrowed money and clothes. I have let him have if he is living. Likewise my mare, if I own one. If not living my executors may consider that debt cancelled 10th and sell my mare, wagon, carriage and my gold watch that was L S and give the awards to the Baptist Foreign Missionary fund as I am a life member of that society. 11th I give and bequeath the sum of one hundred dollars to my cousin Elizabeth A. Russell of the Town of White Creek 12 I give and bequeath the sum of fifty dollars to my cousin Giles Russell of the Town of White Creek. 12 If any of my legatees or others make or cause to make any trouble in the proof of this will I hereby direct my executors to withhold their legacy and they are not to have anything for I feel as the sole owner ( ) of what I possess except my Heavenly Father and with his permission I desire my every wishes be carried out to the letter and all the legatees be dependent on their acquiescence in this will. I am perfectly sane on this subject not crazy. 12 It is my wish after my decease to be buried beside my beloved husband L. Stark and to have the old monument removed if not done before and one put up suitable for both. I shall have a letter to my husband John A. Quaw with my wishes stated in it as a part of my will and likewise one to my nephews and niece & others. It is my wish they should be caused carried out as though I was alive. 13th After paying all debts and legacies & expenses if there any more property to dispose of I want the amount got together and given to the Home Mission Society for the board to use for the best interest of the Society and may God blessing go with it for it is all my hard earnings. I wish this all to be settled with (within) two years if possible with distressing any one that is owing me; some of my notes will probably be paid and some not. I hereby nominate and appoint Giles Russell and R. [Klerocker?] both of the Town of White Creek Washington County State of New York my executors of my Last Will and Testament. I hereby annul all former wills by me made. In witness whereof, I have set my hand and seal this 20th day of May in the year of our Lord eighteen hundred and seventy six. Hagle being severally and duly [ ] and examined before Albert Hobbs, surrogate of the County of Franklin on behalf of the application to prove said will do depose and say as follows We were each well acquainted with Delight M. Quaw, deceased. The subscription of the name of said decedent to the instrument now shown to us and offered for probate as her last will and testament and bearing date the 20th day of May in the year of our Lord one thousand eight hundred and seventy six was made by the decedent at the residence of William Hagle in Fort Covington in the presence of us and each of us subscribing witness to said instrument. At the time of her making such subscription the said decedent declared the said instrument subscribed by her to be her Last Will and Testament and we the undersigned therefore subscribed at the request of said decedent and in her presence and in the presence of each other, The said decedent at the time of so executing said instrument was upwards of the age of twenty one years and of sound mind memory & understanding, and not under restraint or in any way incompetent to devise real estate.
